Job Summary
*This position has a flexible work arrangement that may allow for Telework or a mixture of working in our office and Telework .*
*Statewide travel and approximately 6-8 overnights per month.*
This position exists to execute the responsibilities of the Commissioner of Human Services pursuant to the provisions of the Human Services Licensing Act, the Background Study Act, Reporting of Maltreatment of Minors Act, Reporting of Maltreatment of Vulnerable Adults Act (VAA), Minnesota Data Practices Act, and the Health Insurance and Portability and Accountability Act and other applicable state and federal laws and rules governing the provision of services by a Department of Human Services (DHS) licensed program or service. Licensors in this position:
  • Assist unit supervisor/manager in tasks that support the unit such as distribution of caseloads, data and trend analysis, data reporting, researching complex policy and protocol issues.
  • Train new licensors on division protocols, resources, and systems. Review and edit compliance orders of new staff to assure that they comply with division protocols and standards.
  • Conduct licensing inspections, investigate complaints of alleged licensing violations, evaluate applications, changes in the terms of a license and variance requests to determine compliance with and to enforce licensing requirements. The requirements apply to a wide range DHS licensed residential and nonresidential programs serving children, vulnerable adults, including adult day services.
  • Develop and enforce corrective action plans and interventions, as applicable, to assist license holders in complying with regulations that ensure the ongoing protection of the health, safety, and rights of the children and adults served in these facilities.
  • Interpret the requirements of laws and regulations that apply to all DHS licensed programs as listed above.
  • Assist unit supervisor/manager with the development of licensing policies, procedures, protocols, and forms that are designed to achieve a high level of quality and consistency in investigations, inspections, and subsequent actions. Exercise independent judgment in the application of agency policies and procedures.
  • Complete licensing actions that are subject to public scrutiny through the license holders' and applicants' rights to due process and through public posting of the most frequently requested licensing action on the DHS website. Work must be able to be upheld under legal challenge, including administrative reconsideration, and licensors are called upon to testify in contested case hearings.
  • Adhere to state and federal data practice requirements.
  • Coordinate work with other divisions and external state and federal agencies related to funding and fiscal program integrity issues. T his includes joint investigations when the issues extend beyond program licensing standards (e.g., fraud investigations).
  • Work with stakeholder groups, including those that are internal and external to DHS.
  • Provide training to provider organizations and providers.

Qualifications
Minimum Qualifications

Three (3) years professional experience conducting investigations of alleged licensing violations, licensing inspections, and/or evaluating license applications to determine whether license holders and/or applicants are in compliance with general and program specific licensing requirements.
  • Develop and/or maintain systems, processes, and/or forms to be used within the unit and/or provide lead on implementation.
  • Knowledge of current methods of delivering services to vulnerable adults, children and others receiving services in licensed programs.
  • Information analysis and/or decision making.
  • Provide training to provider organizations.

Preferred Qualifications
  • Skilled in written and oral communications.
  • All applicable Minnesota Statutes and Rules pertaining to licensure by the Department of Human Services (DHS), including 14 program specific regulations.
  • All applicable Federal laws and rules pertaining to licensure by DHS.
  • Problem solving activity is focused on protecting the health, safety, rights, and well-being of those receiving services in programs that are licensed by DHS.
  • Organizing and scheduling investigative activities and all other responsibilities to meet the goals of the division and units for quality and timeliness of all work assigned.
  • Teamwork to ensure the goals of the division and the units are met.
  • Ability to communicate complex concepts, ideas, and proposals in a clear and concise manner, perform focused and relevant research, and establish and maintain effective relationships with other agencies and organizations.
  • Variety of experiences working effectively with others from different backgrounds and cultures.
