DEFINITION
Under direction, performs professional level work related to the appraisal, acquisition, management, improvement, transfer, sale, and disposal of Real Property; manages landlord and tenant relations; assists in administration of County franchises; searches and verifies records and manages Real Property records for the County; provides relocation assistance, valuation, and property management of Real Property and Real Property rights; and performs related duties as assigned.
SUPERVISION RECEIVED AND EXERCISED
Receives direction from Assistant Director, General Services or designee. Exercises no direct supervision over staff.
CLASS CHARACTERISTICS
This is the journey-level classification in the Real Property Agent series. This classification is responsible for independently performing professional duties in support of the Real Property division of the General Services department. Positions at this level exercise judgment and initiative in their assigned tasks, receive only occasional instruction or assistance as new or unusual situations arise and are fully aware of the operating procedures and policies of the work unit. This class is distinguished from the Senior Real Property Agent in that the latter performs the more complex and fully functional work assigned to the series, such as technical, specialized, and detailed tasks associated with valuation, acquisition, leasing and Real Property asset management and/or providing technical and functional direction over lower-level staff.
Essential Job Functions
EXAMPLES OF TYPICAL JOB FUNCTIONS
Typical functions may include any of the following tasks, knowledge, abilities, and other characteristics. Incumbent(s) may not be required to perform all duties listed, and may be required to perform additional, position-specific tasks.
  • Performs property management duties for County owned/leased Real Property.
  • Performs real estate due diligence and analysis for real estate transactions.
  • Assists in developing appropriate franchise agreements and perform site inspections to evaluate performance against agreement.
  • Prepares and maintains files of County lease agreements and amendments; provides for and negotiates repairs and maintenance for leased properties; ensures that leased properties are appropriately insured.
  • Tracks leased facility lease roll to recommend necessary action at key milestones within lease agreements such as lease termination.
  • Develops market rent surveys, estimates real estate needs and space requirements for offices and other physical facilities for County departments and activities, and assists in lease negotiations with property owners.
  • Facilitates tenant relations to fill vacancies, attend walk through inspections, coordinates necessary maintenance issues, collections and terminations including eviction.
  • Drafts Purchase Offers and Lease forms reflecting negotiated terms, using County template documents.
  • Serves or posts notices concerning property acquisitions and leasing proceedings.
  • Manages escrow accounts and assist in resolving escrow conflicts.
  • Drafts license use agreements for short-term, single event, and/or emergency services.
  • Updates electronic and hard file Real Property inventory data.
  • Prepares real estate documents such as appraisal summary statements, deeds, and certificates of acceptance.
  • Examines and interprets title reports to verify boundary descriptions and various recorded real estate documents.
  • Assists in development and maintenance of Real Property Division Policies and Procedures.
  • Assists in the preparation of resolutions for presentation to the County Administrative Officer, Board of Supervisors, and other County Departments.
  • Inspects and researches Real Property to determine fair market value; reviews Real Property appraisals provided under contract.
  • Researches ownership of properties through title documents, deeds, and related documents.
  • Meets with property owners to present appraisal and formal purchase offer; obtains deeds and purchase contracts from property owners.
  • Performs studies regarding vacant or occupied properties for future purchase and conducts rental comparisons.
  • Processes the abandonment of public rights of way; coordinates with other departments to clear property for vacation.
  • Researches right-of-way documents and provides technical information to agencies, businesses, and private parties.
  • Maintains accurate records and files.
  • Performs related duties as assigned.

Minimum Qualifications
Knowledge of:
  • Applicable federal, state, and local laws, codes, and ordinances relevant to the area(s) of responsibility.
  • Principles and practices of appraising and negotiating for Real Property, property rights or leased property.
  • Principles and practices of Real Property management, appraisal, acquisition, leasing, disposal, and department relocation assistance.
  • Principles and practices of right-of-way, condemnation, and other public agency Real Property matters.
  • Techniques for providing a high level of customer service by effectively dealing with the public, vendors, contractors, and County staff.
  • The structure and content of the English language, including the meaning and spelling of words, rules of composition, and grammar.
  • Modern equipment and communication tools used for business functions and program, project, and task coordination, including computers and software programs relevant to work performed.

Ability To:
  • Negotiate and communicate between landlords, tenants, vendors, and contractors regarding maintenance, repair, and lease terms.

  • Prepare and review Real Property-related documents.
  • Read and understand quasi-legal terminology found in statues relating to the laws, policies, rules, and regulations related to Real Property transactions for public purposes.
  • Assemble and analyze data; understand the effects of deed restrictions, zoning ordinances, setbacks, tax and improvement assessments, easements, and encroachments on Real Property and Real Property rights.
  • Negotiate real estate transactions, contract terms, and conditions; manage escrow/title accounts.
  • Analyze interpret, explain, and apply technical policies, procedures, codes, statutes, descriptions, and documents related to work performed.
  • Maintain organized and accurate records.
  • Understand, interpret, and apply all pertinent laws, codes, regulations, policies and procedures and standards relevant to work performed.
  • Independently organize work, set priorities, meet critical deadlines and follow-up on assignments.
  • Use tact, initiative, prudence and independent judgment within legal, general policy and procedural guidelines.
  • Effectively use computer systems, software applications relevant to work performed and modern business equipment to perform a variety of work tasks.
  • Communicate clearly and concisely, both orally and in writing, using appropriate English grammar and syntax.
  • Establish, maintain, and foster positive and effective working relationships with those contacted in the course of work.
  • Make accurate mathematical computations and calculations.

Education and Experience:
Any combination of training, experience and educational degrees that would provide the required knowledge, skills, and abilities is qualifying. Substitutions will be made on a year for year basis. A typical way to obtain the required qualifications would be:
Associate's degree from an accredited college or university with major coursework in real estate, business administration, public administration, or a related field; and
Two (2) years of increasingly responsible experience performing real estate transactions including property management for commercial real estate interests, Real Property analysis and appraisal.
Certifications and Licenses:
  • Must possess a valid US driver's license upon date of application. Must obtain California driver's license following hire date per California DMV regulations.
  • Possession of one of the following: a valid sales or broker real estate license issued by the California Department of Real Estate; Real Property Appraisal level AL-Residential License, AR-Certified Residential License or AG- Certified General License issued by the CA Bureau of Real Estate Appraisers; or Professional Real Property Management designation/certification such as ACoM-Accredited Commercial Manager, RPA-Real Property Administrator, CPM-Certified Property Manager.

Environmental Factors and Conditions/Physical Requirements
PHYSICAN DEMANDS
  • Mobility to work in a standard office setting and use standard office equipment, including a computer: to operate a motor vehicle and visit various County sites; primarily a sedentary office classification although standing in work areas and walking between work areas may be required; occasionally bend, stoop, kneel, reach, push and pull drawers open and closed to retrieve and file information; ability to lift, carry, push, and pull materials and objects up to 10 pounds.
  • Vision to read printed materials and a computer screen.
  • Hearing and speech to communicate in person and over the telephone.
  • Finger dexterity is needed to access, enter, and retrieve data using a computer keyboard or calculator and to operate standard office equipment.

WORKING CONDITIONS
  • Office environment with moderate noise levels, controlled temperature conditions and no direct exposure to hazardous physical substances.
  • Also includes field work with exposure to loud noise levels, cold and hot temperatures, inclement weather conditions, toxic/poisonous substances, biologic /infectious agents, dust, fumes, and allergens, unpleasant odors, vermin, insects, and parasites.
  • Employees may interact with upset staff and/or public and private representatives in interpreting and enforcing departmental policies and procedures.

EQUIPMENT AND TOOLS UTILIZED
  • Equipment utilized includes personal computer, fax machine, standard office equipment, laser distance measurer, short run measuring wheel, and a camera.

Disaster Service Worker
All Butte County employees are designated Disaster Service Workers through state and local law (California Government Code Section 3100-3109). Employment with the County requires the affirmation of a loyalty oath to this effect. Employees are required to complete all Disaster Service Worker related training as assigned, and to return to work as ordered in the event of an emergency.

Salary Step Increases:
The beginning salary and the top of the salary range are usually shown on the job announcement. Upon satisfactory service, salary increases of approximately 5% may be given annually until the top of the salary range has been attained.
Cell Phone Allowance:
County issued cell phone or $70/month allowance with appointing authority approval.
Boot Allowance:
$200.04 annuallly, paid in equal monthly payments through regular pay checks.
Holidays:
12 paid holidays per year.
Vacation:
0-4.99 years: 15 days/yr.; 5-9.99 years: 20 days/yr.; 10-19.99 years: 25 days/yr.; 20+ years: 27 days/yr. Note - accrued vacation leave may not be used until after six months of employment.
Administrative Leave:
7 days per year for FLSA Exempt employees.
Sick Leave:
96 hours of sick leave are earned each year with no maximum accrual.
Bereavement Leave:
Maximum of 40 hours for each occurrence in the immediate family.
Health Plan including Dental Insurance and Vision Insurance:
Coverage under the Butte County Health Plan is for employees and their eligible dependents. Depending upon the plan selected by the employee, the County contributes a substantial amount of the total cost of the complete health package, which consists of medical, vision, and dental insurance. Currently, the amount the County contributes for family coverage is $1438.42/month. For those employees who have health coverage from other sources, and who elect to not participate in the Butte County Health Plan, the County offers a monthly taxable Cash-Back allowance. The current of the taxable Cash-Back allowance is $503.34 per month (prorated for less than fulltime employees). This benefit is $300 per month for Employees hired on or after January 1, 2014.

The County provides $25,000 in life insurance with additional coverage available at a minimal cost.
