Position Overview

The Yunex Traffic Contract and Claim Manager is part of the team in Miami, Florida bringing at least 3 years of working experience in infrastructure projects to the local operation.

The Contract and Claim Manager is part of a state-of-the-art ATMS operations team during its implementation and operation phase. This role requires applying project operation practices and to strive for project excellence applying utilizing collaboration, communication, and change management skills.

Responsibilities of this role include the operative and strategic management of contracts and any deriving changes based on solid leadership, technical, organizational, and communication skills and a proven track record in similar roles.

 

Position Requirements

  • Advanced degree in Engineering or Business Administration with relevant work experience in contract management with legal domain for US infrastructure and governmental projects
  • Alternatively, MBA or legal degree with relevant experience as contract manager for infrastructure systems projects
  • Minimum of five (5) years in progressively responsible positions with construction/contracts/commercial transactions in a law firm or a corporate environment
  • Consistent track record in commercial transactions and /or litigation.
  • Excellent professional, legal written and verbal communication, and interpersonal skills
  • Experience in project controls for US infrastructure and governmental projects
  • Good understanding of the market conditions and project execution in South Florida.
  • Excellent negotiation skills and experience
  • Ability to produce quality materials within tight timeframes and simultaneously manage several assignments
  • Specialized skills and proficiency with project/program controls software and web-based program management systems
  • JD and admission/licensed to practice law in one or more states beneficial.

 

Responsibilities

  • Analyze, evaluate, and resolve diverse matters with government agencies, commercial customers, partners, supplier, and subcontractors.
  • Participate in negotiations with clients, partners, suppliers, and subcontractors, and prepare legally binding documents.
  • Identify and assess the primary contractual risks, opportunities and requirement and communicates them within the project team.
  • Cooperate with the project management to define the contract strategy.
  • Liaise with technical and financial staff, sub-contractors, legal teams, and the client’s own representatives.
  • Establish an adequate systematic for incoming and outgoing claims during the project execution by proper identification of claim possibilities to customer and suppliers.
  • Provide good tracking of contract and claim relevant events supporting evidence to each event.
  • Ensure that adequate communications are drafted, reviewed, aligned, and sent in a timely matter to the involved stakeholders.
  • Prepare contract concepts and defense strategies.
  • Prepare and execute project-related Contract & Claim Workshops / Contract Readings with the project team. Ensure that contract requirements applicable to each area are understood by the team members.
  • Consult with management and legal and draft official correspondence towards the client and suppliers/subcontractors in a timely, clear, and professional manner.
  • Develop risk mitigation and settlement strategies and negotiate and finalize settlement agreements where necessary.
  • Monitor contract conditions and events (duration, consequences, losses), deadlines, milestones and contract-related correspondence and act accordingly.
  • Undertake the task to justify and provide legal support on other issues that may constitute opportunities.
  • Defend against external claims from clients, partners, suppliers, and subcontractors through the presentation of relevant exonerative facts and documentation.
  • Prepare, participate and post-process claim negotiations together with the project management.
  • Report to project management, management, and legal functions about the status of the project related to contract and claim management and inform timely about relevant events and actions.
