The Clerk of Court provides clerical and non-judicial support to assist the municipal judge ensuring compliance with all applicable laws and regulations, the proper collection and distribution of Court fines and fees, and the maintenance of accurate and complete court records. The Clerk makes sure procedures and processes are current by attending professional training and maintaining accurate financial procedures.
Essential Duties and Responsibilities:
- Supervises department employees which involves such duties as instructing, assigning, and reviewing work, maintaining standards, acting on employee problems, selecting new employees, appraising employee performance, recommending promotions, discipline, termination, salary adjustments and payroll.
- Directs non-judicial functions, business, and revenue of the Municipal Court. Manages the business and court revenue for the City; ensures compliance with all State and local regulations and requirements.
- Records and provides information on the disposition of cases; enters dispositions on cases at completion; obtains and completes information to refer defendants to programs. Communicates directives, laws and operational procedures to the judges and staff for effective and lawful adjudication of cases and procedural compliance.
- Develops and monitors schedules for court sessions and judges.
- Prepares and monitors the court budget and direct expenditure of department funds; reviews and prepares requisitions for goods and services for the court. Ensures that Court Clerks adhere to the ethics for court staff to include the Cannons of Judicial Conduct.
- Serves as liaison between citizens, judges, city prosecutor, staff, other departments, City administrator, trial diversion programs, solicitors, other courts, public defenders, attorneys, outside agencies, victims, police officers, Department of Motor Vehicles, and the public.
- Secures information for judges; contacts witnesses, attorneys to obtain information for court; instructs parties when to appear in court; explains procedures or forms to parties in case.
- Examines legal documents submitted to court for adherence to law or court procedures; prepares case folders, posts, files, or routes documents. Coordinates with the Chief Judge on the planning, organizational, and implementation of functions of the judicial section of the court.
- Coordinates court proceedings and appeals; prepares the return; forwards transcripts and appeals to the appropriate county and clerk.
- Supervises the collection of monies derived from court related business, the preparation of bank transmittal to include proper disbursement of funds to the Finance Department while accounting for the distribution of various fees and assessments and necessary paperwork. Verifies and issues refunds and restitution due to victims.
- Supervises clerical staff in the preparation of dockets, data entry, tickets, ticket transfers, charging bond form transmittals, subpoenas, and jury summons, ensures timely and accurate completion; supervises trial diversion programs and inventory control. Oversees the suspension of driving license privileges and issuance of bench warrants, reports disposition to the Department of Motor Vehicles and SLED.
- Coordinates the jury management program to include pulling jurors for service; oversees the selection process for jury trials; communicates with the Election Commission regarding jurors and updates.
- Establishes qualifications for accepting partial payments; approves late payments; monitors and schedules payment of fines by defendants; initiates bench warrant when collection efforts of payment schedule are not satisfactorily followed.
- Implements and maintains policies regarding notification of victims as required by State law in the absence of the Victim's Advocate.
- Attends department head meetings, finance meetings and City Council meetings as required.
