This position provides program management for the self-insured liability program for the state, which includes; oversight of the state insurance broker, negotiates settlement of liability claims and lawsuits, authorizes payments for losses and services, manages outside counsel contracts, their assignments and expenses, monitors Medicare compliance reporting, manages collections of fees/costs owed to State, and provides risk management and insurance consulting services to all members of the Risk Management Liability Pool. There are operational duties associated with these programs performed by other positions in Risk Management that are not under the direct supervision of this position, however this position provides the leadership and much of the direction of these duties.

A summary of the duties and responsibilities will include, but are not limited to, the following:



Essential Duties and Responsibilities

Liability Lawsuit Program Management: Functions as the staff authority to manage statewide self-insured liability program. Program management includes: 1) Analysis of loss exposure for each lawsuit/case. 2) Establishment of legal and indemnity claim reserve amounts; 3) Direction of investigating and legal activities by outside legal counsel; 4) Approval of settlements negotiated by internal (Office of the Attorney General) and external (outside counsel contracts) legal counsel; 5) Authorization of payment documents for liability claims and for outside council contracts with Risk; 6) Development of outside counsel performance standards, monitor contract performance and monthly expenses; 7) Representation of the state at lawsuit mediations or settlements; 8) Preparation of reports for management detailing loss trends, financial impact of losses, monthly status of legal counsel activities and evaluation of lawsuit/cases costs; 9) Administer processes for reporting compliance with Medicare 111 Act of 2007 (MMSEA); 10) Provide oversight and manage collection processes with external collections agency for costs/fees owed to the State; 11) Communicate with managers in other state departments to provide loss information and claim updates as needed, 12) Assist Risk Manager with information requested related to previous claims or processes over the past decade. Provides direction to administrative support staff for activities connected to the administration of the program.
General Risk Management and Insurance Consulting Services: 1) Manage the contracted insurance broker in support of Statewide insurance. 2) Support SORM member Departments and IHEs with individual insurance needs, including working with the contracted broker for specific policies, and assisting to procure new policies to meet unique needs. 3) Communicate daily with officials in state departments regarding application of state laws to exposure scenarios, coverage's available via state liability insurance policies and similar issues. 4) Coordinate with contracted broker, and collect data from Agencies, for the annual insurance renewal for all programs. 5) Manage annual contract renewals for SORM, coordinate with State Purchasing, utilize CORE system to create initial renewal request and confirm annual contract payments through Accounting. Other duties as assigned.
Unemployment Insurance Contract Management & other duties as assigned: 1) Discuss any issues with Account Executive when coordinating with Departments and agencies. 2) Analyze quarterly reports to offer suggestions in cost-saving measures. 3) Analyze unemployment processes for efficiency and effectiveness between State, Unemployment Third-Party Administrator (TPA) and Colorado Dept. of Labor and Employment. 4) Maintain communications between Departments and TPA regarding processes, training and reporting mechanisms.

MINIMUM QUALIFICATIONS:
Experience Only:
At least eight (8) years of professional experience in an occupational field related to the work assigned to the position.
OR
Education and Experience:
At least four (4) years of professional experience in an occupational field related to the work assigned to the position. AND at least a Bachelor's degree from an accredited institution in a field of study related to the work assignment.
Substitutions:
Additional appropriate experience will substitute for the degree requirement on a year-for-year basis Or Additional appropriate education will substitute for the required experience on a year-for-year basis

The exceptional candidate will possess the proven ability or accomplishment in the following preferred qualifications:

  • Previous State Service related to the work assigned to the position

APPEAL RIGHTS:

An applicant who has been removed from an employment list or removed from consideration during the selection process may request a review by the State Personnel Director.

As an applicant directly affected by the results of the selection or comparative analysis process, you may file a written appeal with the State Personnel Director.

Review of the completed, signed and submitted appeal will be timely on the basis of written material submitted by you, using the official appeal form signed by you or your representative. This form must be completed and delivered to the State Personnel Board by email at dpa_state.personnelboard@state.co.us within ten (10) calendar days from your receipt of notice or acknowledgement of the Department's action.
