Primary Duties
1. Determines liability and adjusts third-party claims filed against the company. Interviews claimants, witnesses, and other parties, gathers and reviews law enforcement, fire, medical, and other official documents, and analyzes audio, video, and photographic evidence that may be available. Methods of investigation vary according to type and magnitude of claim. Submits approved claims for payment and denies unsubstantiated claims.
2. Negotiates, settles, and issues claims reimbursement within established guidelines. Prepares and requires claimants to execute "Confidential Release of Claims" prior to submitting a request for payment. Payments range from nominal to high-dollar reimbursements and settlements. Interacts directly and daily with Atmos Energy customers and other third-party claimants through calls and written communication. Guides claimants through the claims process and supports the Company's vision by providing exceptional customer service throughout the claims process.
3. Gathers and provides records, documents, and other information to outside counsel and legal team to support company's defense against litigation and high-risk claims. Prepares employees to be served with service of process by setting expectations about the process. Consults outside counsel and legal team before releasing fleet vehicles under legal hold. Issues Legal Holds for the preservation of evidence in anticipation of litigation and issues Litigation Holds when litigation is filed. Refreshes Legal and Litigation Holds as needed. Coordinates repairs, joint inspections, CDR and ECM downloads, and reinstatement of service vehicle with operations, outside counsel and legal team.
4. Identifies business risks and reports them to appropriate groups so necessary steps are taken to reduce the Company's exposure. Works closely with operations, fleet management, third-party administrator, outside counsel and members of Atmos legal team. Also works with teammates across the enterprise and engages outside services professional staff as needed.
5. Primary responsibility for managing claims in assigned region but supports division and/or enterprise engagements as needed.
6. Provides records and input to assist Third Party Administrator (TPA) in making liability decisions for third-party fleet claims. Monitors TPA claims and activity to ensure Atmos Energy's interests are being protected. Seeks recovery from responsible third parties for fleet damages utilizing a variety of methods such as written demands to claimants and/or insurers, support from state department of insurance, filing subrogation lawsuits, or engaging collection agency.
7. Documents, tracks, analyzes, and reports on company claims activity. Updates division personnel each month regarding the financial status of claims exceeding established monetary limit. Reviews reasonableness of monthly TPA invoice and if reasonable, submits for payment.
MINIMUM REQUIREMENTS
Education/Experience Level
Requires Bachelor's Degree in Business, Liberal Arts or a related field and three years experience in claims and/or litigation management, or equivalent.
Must be a Claims Adjuster certified by the State of Texas Insurance commission or be willing to be certified. Must complete annual continuing education hours to maintain Texas adjuster's license.
Requires knowledge of natural gas, as well as a basic knowledge of claims administration standards.
Communication Skills
Requires the ability to communicate with internal and/or external customers. Communicates with Atmos Energy customers and other third-party claimants. Guides individuals through claims process while supporting Company's vision of providing exceptional customer service. Provides claim adjustment explanations and/or modifications to claimants and works with forensic accountants on complex business interruption claims. Strong oral and written skills are essential, along with effective negotiation skills.
Numeric Skills
Determines claim value and settles based on reasonable valuation. Must possess numeric reasoning and computation ability.
Computer Skills
Requires strong PC skills including, but not limited to, Microsoft Office (Workspaces, Excel, Word, Workday, and PowerPoint). Origami experience preferred.
Work Conditions
Works both on-site and in the field; must be available 24 hours/day, 7 days/week, to immediately respond and travel to various division locations based on need.
Work is occasionally outdoors, and may require occasional long, irregular hours. May be required to report to out-of-town locations for extended periods to establish and operate remote claims servicing centers.
Requires occasional overnight travel.
Requires occasionally performing activities including, but not limited to, bending, stooping, grasping, reaching, twisting, turning and/or lifting.
