Role and responsibilities

Senior Patent Counsel, Team Leader will be performing a wide range of IP management,people management and patent law functions arising within ASML US Inc. andCymer Inc. (collectively referred to as the "Company") to ensure strong IPprotection and risk mitigation for the Company. This position is based in San Diegoreporting into the Head of Patents EUV / CLS of the Netherlands-based ASMLCorporate Intellectual Property group ("CIP").
This position mayrequire access to controlled technology, as defined in the ExportAdministration Regulations (15 C.F.R. 730, et seq.). Qualified candidatesmust be legally authorized to access such controlled technology prior to beginningwork. Business demands may require the Company to proceed with candidates whoare immediately eligible to access controlled technology.

  • Day-to-day supervision, guidance and leadership to Company Patent Counsel consistent with Company policies and procedures.
  • Coordinate various aspects of the Company's patent filing program with CIP, including review and selection of invention disclosures for which patent protection will be sought. Additionally, this position will provide intellectual property law guidance, including freedom to operate advice, to Company scientists, engineers, and management.
  • Overseeing the preparation and prosecution of patent applications in the U.S. Patent Office and internationally.
  • Assess patent and other IP positioning of competitors (i.e., freedom to operate).
  • Lead and oversee outside counsel consistent with Company objectives and operating guidelines to e.g. properly prepare and prosecute patent applications in assigned area(s) of responsibility.
  • Support execution of Company IP strategies including patent filing and product clearance. Make recommendations to protect innovations developed in research, incubations, and invention harvests.
  • Provide guidance and counsel regarding infringement to Company executives as requested or deemed appropriate.
  • Evaluate third party patent infringement claims against Company subject matter areas of interest including research, products, or technologies.
  • Occasionally assist with advising or structuring and/or negotiating in-bound or out-bound patent licenses as directed and/or requested by CIP and/or Company management.
  • Conduct and/or direct administrative staff in the conduct of legal research directed to resolving legal and/or procedural issues encountered in the advancement of, or challenges to, Company intellectual property assets.
  • Perform IP audits and inventories in connection with new product and process offerings consistent with Company product development and release procedures.
  • Perform other duties as assigned.
Education and experience
  • Juris Doctorate (J.D.), from an accredited law school with excellent academic performance.
  • Bachelor's Degree in the engineering or physical sciences disciplines such as electrical, mechanical, systems and controls science, physics, materials, or optics.
  • Master's degree a plus.
  • 10+ years of relevant patent experience.
  • 5+ years of leadership experience.
  • Must be licensed and in good standing to practice law in at least one U.S. state or the District of Columbia.
  • Must be licensed and in good standing to practice before the United States Patent Office.
  • Experience with physics, optics, and/or image processing a plus. 
  • Experience in managing inside and outside counsel.
  • Ability to render compelling written descriptions and arguments along with graphic explanatory devices.
  • Excellent client/customer service ethics and skills, with an advanced understanding of client relationship-building.
  • Ability to draft and file patent applications in a cost-efficient manner.
  • Proficient ability to plan and direct administrative staff and others in activities supporting the Company's legal work and objectives.
  • Broad technical knowledge, familiarity with all relevant technologies.

The California baseannual salary / hourly range for this role is currently $194,625- $324,375. Payscales are determined by role, level, location and alignment with market data.Individual pay is determined through interviews and an assessment of severalfactors that that are unique to each candidate, including but not limited to,job-related skills, relevant education and experience, certifications,abilities of the candidate and pay relative to other team members.
