Job Description and Duties:
The Native American and Tribal Affairs (NATA) section provides legal representation and advice in litigation, administrative, transactional, tribal-state compact, and other matters involving Native American law and state and federal gambling laws. This includes consulting with the Attorney General, other Department of Justice sections, and other federal, state, and local agencies. NATA's principal clients are the Governor, the Bureau of Gambling Control, the California Gambling Control Commission, and the Native American Heritage Commission. The section's matters involve important state policy issues and are of particular interest to the affected communities, news media, and the Governor's office.
Deputies in NATA work on a broad range of significant legal matters for the Attorney General and its client agencies involving Indian law and/or gambling law, including negotiations for tribal-state class III gaming compacts, state-regulated gambling in non-tribal gambling establishments, civil and criminal jurisdiction on tribal lands, tribal cultural resource protection, civil litigation, government-to-government consultation, and the legal relationships between Native American organizations and the State. NATA Deputies must be able to handle sensitive matters, employ excellent research and writing skills, and possess the ability to negotiate in a challenging environment.

Working Conditions:
Depending on work location, this is a hybrid or remote telework position under current DOJ telework policy, subject to modification. Some in-office attendance may be required. Travel and additional in-person attendance may be required for court appearances, meetings or other occasional operational needs.

  • These positions are located in the Division of Public Rights, Native American and Tribal Affairs section and may be filled in either San Diego, Sacramento or Oakland. Please list your preferred locations in your cover letter.

  • Please note that appointment to the DAG classifications will be made using the following examinations:
    • Attorney exam – less than 5 years of experience: Attorney Examination
    • DAG III exam– at least 5 years of legal experience: DAG III Examination
    • DAG IV exam– at least 6 years of legal experience: DAG IV Examination

Desirable Qualifications:
In addition to evaluating each candidate's relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:
It is desirable but not expected for candidates to have a background in Native American law or state and federal gambling laws. NATA will strongly consider candidates with a litigation background. The ideal candidate is a creative and strategic legal thinker, a self-starter, hard-working, and intellectually curious. Candidates should possess strong analytical, research, writing and verbal communication skills, good judgment, the flexibility to pivot to new projects, and the ability to work under tight deadlines. Candidates should have the ability to work closely and cooperatively with superiors, peers, subordinates and client agency representatives, and be proficient in using Microsoft Word. Candidates should be able to function independently and contribute to team assignments.
