The Truist Insurance Holdings Legal Team is seeking a dynamic litigation attorney to help manage a diverse docket of litigation, defensive claims, and escalated subpoenas in a strategic and efficient manner. The Senior Counsel will maintain strong, productive relationships with key internal clients and outside counsel while also serving as a trusted legal advisor and legal risk manager.
**This position can be a remote opportunity, but proximity to Charlotte or Winston-Salem, NC is preferred**
ESSENTIAL DUTIES AND RESPONSIBILITIES
Following is a summary of the essential functions for this job. Other duties may be performed, both major and minor, which are not mentioned below. Specific activities may change from time to time.
1. Manage defensive litigation and claims, particularly those involving allegations of insurance broker professional liability.
  • Conduct internal fact investigations/witness interviews, analyze exposures and defenses, and advise business partners on legal and litigation risks
  • Select and manage outside counsel, which includes developing legal strategy, approving budgets, reviewing pleadings, facilitating discovery, and optimizing case resolutions
  • Prepare reports for senior management on matter developments, exposure and opportunities for resolution
  • Actively participate in mediation, arbitration, or trial

2. Advise businesses on responding to third-party subpoenas seeking documents or testimony.
3. Manage e-Discovery processes, including conducting custodian interviews and using e-Discovery tools and vendors.
4. Train and advise internal clients on how to avoid errors and omissions or other kinds of legal liability
  • Develop/track defensive claims and litigation data
  • Identify litigation trends
  • Recommend corrective measures and/or share lessons learned

5. Perform legal research and communicate findings in a clear and concise manner.
6. Apprise clients and risk partners of developments in case law relevant to their businesses.
7. The position will not have any direct reports, but will be supported by, and have informal oversight of, a paralegal.
QUALIFICATIONS
Required Qualifications:
The requirements listed below are representative of the knowledge, skill and/or ability required. Reasonable accommodations may be made to enable individuals with disabilities to perform the essential functions.
1. Juris Doctorate from an accredited U.S. law school and member in good standing in at least one State bar
2. 2-5 years of litigation experience at a large law firm (preferably representing insurance brokers, insureds or insurers) or in-house legal department (preferably of an insurance brokerage or insurance company)
3. Excellent oral and written communication skills
4. Ability to effectively and persuasively communicate complex issues and strategies with employees at all levels, including senior executives
5. Strong analytical skills and ability to balance business needs with legal risks 6. Well-organized self-starter able to exercise sound judgment and provide legal advice in a fast-paced environment with tight deadlines
7. Ability to independently deliver results, multi-task and prioritize work based on company/client priorities and strategic goals
8. Demonstrated willingness to be nimble, work as part of a team, collaborate and build relationships with colleagues and business partners
9. High energy, positive influence and attitude, flexible, and exceptional work ethic and passion to win
Preferred Qualifications:
1. Up to five years of experience practicing law with a specialty in insurance-coverage litigation.
2. Experience with electronic discovery processes and procedures.
