SUMMARY
Performs legal and administrative duties requiring knowledge of computer databases, civil procedure, and certain substantive areas of law. Handles the most complex of paralegal duties including coordinating discovery in the largest cases. Ensures the integrity and resolves problems of various databases. Develops data; performs analyses and summarizes files and written material from other departments.
ESSENTIAL DUTIES AND RESPONSIBILITIES include the following:
Manipulates data in OGC databases for reports to Trustees, attorneys, and other staff. Assists in preparation of reports.
Maintains system of accounting for accounts handled by OGC, and coordinates payment and collection information with appropriate departments.
Analyzes and summarizes data from withdrawal, audit, no longer in business, income, eligibility, bankruptcy, and litigation files in complex cases.
Contacts state corporate information offices: District Courts, Appellate Courts, bankruptcy courts, Mine Safety and Health Administration (“MSHA”), and other federal and state agencies to determine status of delinquent corporations. Coordinates Freedom of Information Act requests to various agencies.
Reviews and summarizes data from numerous Funds’ databases, and “online” services such as Lexis Advance and PACER, and other relevant websites.
Completes workups regarding uncollectible cases, including draft memos to Associate General Counsel.
Reviews depositions, interrogatory responses, and document production requests. Gathers and organizes documents for response to litigation requests and audit information requests.
Makes initial determinations on existence of control group members and other entities subject to suit.
Researches and analyzes corporate and individual relationships to employee benefits plans administered by the Funds to assist in identifying Parties in Interest under ERISA. Assists OGC staff in research and preparation of the Parties in Interest report used to ensure compliance with ERISA.
Drafts complaints, affidavits, interrogatories, proofs of claim and motions for attorney review; and prepares/handles service of process on complaints.
Files various pleadings with the Appellate, District and Bankruptcy Courts using the Electronic Court Filing Systems (“ECF”). Files proof of claims “online” and via certified mail with Claims Agents.
Corresponds with local and outside counsel concerning case status and sources for collection.
Reviews and summarizes incoming mail and pleadings for entry in a case management database. Utilizes OGC’s case management database in performance of day-to-day tasks.
Operates office equipment, including but not limited to, photocopiers, calculator, printers, imaging hardware, desktop computer and/or laptop.
Assists legal staff in carrying out the various activities of the Office of the General Counsel.
Maintains confidentiality of audit workpapers, coal company and/or beneficiary information.
Responsible for adhering to all Funds’ policies and procedures adopted to comply with the Health Insurance Portability and Accountability Act (“HIPAA”) governing the privacy, security, and use of protected health information.
Travels as required to conduct Funds’ business.
Assists with special projects and day-to-day activities.
QUALIFICATIONS

EDUCATION and/or EXPERIENCE
Bachelor’s degree from an accredited college or university or a comparable degreed program PLUS 6 or more years’ paralegal experience; including 1 year of experience with the following software: case management, calendaring, time and billing, litigation support.
OR
Paralegal Certificate PLUS 6 or more years’ paralegal experience; including 1 year of experience with the following software: case management, calendaring, time and billing, litigation support.
OR
6 or more years’ experience as Funds’ AttorneyAssistant 1 and/or Attorney Assistant 2.
TECHNICAL, BUSINESS, and INDUSTRY KNOWLEDGE
Demonstrated understanding of legal documents. Demonstrated understanding of Funds and/or office policies and procedures relevant to job duties. Demonstrated ability to follow detailed oral and written instructions. Willingness to work overtime, as required, to meet deadlines.
Demonstrated ability to enter, edit, print, and protect data in a worksheet; use formulas to perform basic calculations such as adding, subtracting, dividing, and multiplying, plus an ability to display information and use menus to perform spreadsheet commands.
COMMUNICATION SKILLS
Intermediate - Ability to speak effectively before groups such as Funds' employees, beneficiaries, or third-party administrator for purposes such as gathering information, providing advice or counsel, or making recommendations regarding procedures or policies.
Intermediate - Ability to read and interpret documents such as operating instructions, procedures manuals and processing manuals. Ability to write reports, business correspondence, and procedures manuals.
MATHEMATICAL SKILLS
Intermediate - Ability to calculate figures and amounts such as discounts, interest, commissions, proportions, percentages, area, circumference, and volume.

90 standard workdays pursuant to Sections 5.06, 5.07, and 5.08 of the Collective Bargaining Agreement.
