Workers' Compensation Fraud Investigator

The Offices of the Inspector General (“OIG”) are comprised of three entities, derived from three appointments held by Inspector General Lucy Lang: The Office of the New York State Inspector General (“NYSIG”), as established by Executive Law Article 4-A, which is entrusted with the responsibility of ensuring that New York State government, its employees, and those who work with the State meet the highest standards of honesty, accountability, and efficiency; The Office of the New York State Welfare Inspector General (“OWIG”), as established by section 74 of the Executive Law, which is responsible for maintaining the integrity of New York State’s public assistance programs; and The Office of the New York State Workers’ Compensation Fraud Inspector General (“WCFIG”), as established by section 136 of the Workers’ Compensation Law, which is responsible for investigating violations of the laws and regulations pertaining to the operation of the workers’ compensation system. Additionally, as of June 18, 2021, the duties and responsibilities of the former Office of the Gaming Inspector General were transferred to and encompassed by NYSIG, including the duty to receive and investigate complaints from any source concerning allegations of corruption, fraud, criminal activity, conflicts of interest or abuse in the Gaming Commission. Staff comprising OIG’s New York City Region are assigned to locations in New York City and Suffern.

Job Description

OIG conducts in-depth investigations and analysis of alleged fraud, abuse, corruption, conflicts of interest, and other criminal activity in New York State agencies and entities under its jurisdiction. Investigators work collaboratively with OIG attorneys and auditors to identify, plan, and execute investigations of various types, and to prepare written reports documenting investigative activities and findings. Investigators utilize multiple investigatory techniques, including surveillance, witness/target interviews, digital forensics, and data analysis, including financial records. Investigators often liaise with other federal, state, and local law enforcement agencies and assist in the referral and prosecution of criminal matters. Frequent statewide travel is required as well as a willingness and availability to work unscheduled hours as necessary.

While every OIG Investigator is cross-trained to work on all matters falling under the agency’s jurisdiction, the primary focus of the investigator filling this position will be workers’ Compensation Fraud.

Minimum Qualifications

OIG Investigators conduct large-scale, confidential, sensitive, and internal investigations, most frequently related to contracts, procurements, public benefits, the Workers’ Compensation System, lawful gaming, and white-collar crime, and therefore ideal candidates will have at least five years of investigative experience in some or all of those subject matter areas, as well as significant familiarity with New York State criminal law and procedure and New York State government operations.

Candidates with prior experience in conducting insurance fraud, particularly with a workers’ compensation/health care fraud context, and/or with prior insurance claim/industry experience, will be given high priority consideration. Candidates must also have a bachelor’s degree and valid NYS driver’s license. DCJS-certified police or peace officer status is preferred but not required.
