General Summary:
The VP of Risk & Compliance plays a pivotal role in managing the legal affairs and risks of the organization, overseeing contract negotiations, ensuring compliance with applicable laws and regulations, and representing the company in legal matters. This role is tasked with identifying and mitigating legal risks, managing litigation and dispute resolution, and contributing to the development and execution of business strategies.
Essential Duties:
Stay abreast of federal, state, and local laws, regulations, and industry guidelines affecting the debt settlement industry and the Company as a whole.
Interpret and apply regulatory changes to policies, procedures, and practices. Provide legal advice to the Executive Leadership, Senior management, and other departments on a wide range of legal issues affecting the organization.
Conduct regular compliance audits to assess the Company's adherence to applicable legal requirements as well as established internal policies and procedures.
Ensure the Company’s licenses are maintained and in good standing with state and federal licensing boards.
Offer guidance on business strategies, corporate governance matters, transactions, personnel matters, and day-to-day operations, as requested or assigned.
Identify potential legal risks and develop mitigation strategies.
Directly oversee the Quality Control and Compliance Department, provide oversight of the Human Resources Department in tandem with Senior Leadership of Operations.
Review, draft, and negotiate contracts, agreements, and legal documents to protect the organization's interests and minimize legal risks; ensure that contractual relationships comply with applicable laws and regulations.
Advise on consumer protection laws and regulations to ensure fair and transparent business practices.
Oversee and manage legal disputes, litigation, and regulatory investigations involving the organization.
Work with external legal counsel when necessary, representing the organization's interests in legal proceedings.
Assist in the preparation and filing of regulatory reports and disclosures.
Manage and protect intellectual property, including patents, trademarks, and copyrights, to secure the company's innovations and technologies.
Provide guidance on employment law matters, including hiring, termination, discrimination, and workplace policies.
Work closely with the Human Resources department to address legal issues related to employees.
Ensure compliance with regulatory reporting requirements.
Promote a culture of ethics and integrity throughout the organization; Investigate and respond to reports of potential ethical violations.

Knowledge and Experience
A Law Degree from an ABA Accredited Law School is required.
Valid and active licensure to practice law in the state of California.
A minimum of 5 years’ experience serving as a Compliance Attorney or similar senior legal role in the Financial Services, Fintech, or Debt Settlement industries.
Understanding of the ABA Model Rules, FCRA, UDAAP, TCPA, TSR, and FDCPA regulations.
Skills and Abilities
Ability to learn and use internal systems and software including phone systems, CRM, and other platforms as required.
Computer literacy
Strong knowledge of legal principles and practices
Experience in legal administrative tasks, including managing contracts and litigation
Proficiency in conducting legal research
Excellent negotiation skills and ability to draft clear and concise legal documents
Strong analytical and problem-solving abilities
Exceptional written and verbal communication skills
Salary Range: $150,000 - $200,000 depending on scope of experience and background
