The Senior Counsel, Privacy will partner with the company’s Sr. Director, Global Head of Ethics, Compliance and Privacy to develop the privacy strategy for embecta, and lead the continued development, implementation, maintenance, and enforcement of an effective Global Privacy program to support the company’s expansion and ongoing operations.
The ideal candidate will have prior experience with, and a deep understanding of, privacy laws and other regulations applicable to our business, including but not limited to GDPR and privacy laws and regulations in countries outside of the United States, US state privacy laws (CCPA/CPRA and the recently enacted laws in VA, UT, CT, CO), HIPAA/HITECH, and US state data breach notification laws. This is a fully remote position but can be hybrid if the candidate is located near our headquarters in Parsippany, NJ, or other U.S. locations.
Main responsibilities will include:
  • Support embecta’s internal privacy program, overseeing the Privacy Steering Committee and responding to day-to-day requests for guidance with respect to privacy laws and their application to the company’s new and existing products and processes.
  • Works across functions to design, implement, and enhance privacy operations mechanisms to meet the needs of the company, including, without limitation, processes for vendor/partner privacy onboarding, DSARs, data mapping, data inventory, records of processing activities, DPIAs and PIAs.
  • Facilitate the creation and implementation of “Privacy by Design” standards and practices in accordance with all applicable legal, regulatory, and industry standards.
  • Create a high level of company awareness of privacy standards through continual training, communication programs, and initiatives. Periodically revise the privacy program in light of changes in the organization’s needs or in applicable legal requirements, including those that are jurisdictional.
  • Develop and maintain a deep comprehension of company processes, systems, technologies, data, customers, end users, vendors, and the privacy-related compliance/regulatory environment that the organization operates in.
  • Develop, implement, and update internal privacy policies/procedures/work instructions and external and website privacy notices and statements, including cookie banners, in compliance with applicable law.
  • Create, implement, and manage an annual Privacy Risk Assessment Program.
  • Prepare and refine privacy program metrics (reporting of incidents, breaches, data subject requests, trends) and develop appropriate program modifications.
  • Create, update, and maintain template DPA, BAA, and similar template agreements and assist the Legal and Procurement teams on privacy related contract provisions.
  • Monitor developments in privacy laws and technologies and develop and lead cross functional project teams to create compliance infrastructure.
  • Assist in special projects, and other duties as assigned. May work on compliance matters if interested.
Qualifications
  • JD with at least 5 years of experience required, some of which include privacy experience with relevant issues for a life sciences company. Licensed to practice in at least one state.
  • CIPP/US, CIPP/E and/or CIPM or other relevant privacy certification is highly desirable.
  • Demonstrated experience working with HIPAA/HITECH, GDPR, CCPA/CPRA, CAN SPAM/TCPA and existing or emerging Global Privacy laws and/or state privacy laws.
  • Professionalism, discretion, and judgment through sound decision-making to obtain solutions through collaborative efforts across the company.
  • Strong communication, and project management skills. Ability to drive change and implement new processes.
  • Hands-on, willing to roll-up their sleeves and acts as a partner to the business.
  • Thrives in a fast-paced environment, prioritizes, and handles multiple tasks, and exhibits attention to detail.
  • Experience with Microsoft Office is required. Familiarity with OneTrust platform is a plus.
