Description
The Regional Compliance Officer will be part of a global Compliance team and is responsible for leading the implementation, management and monitoring of an effective Compliance Program and training with focus on high-risk areas and behaviour consistent with Elekta’s values. The Regional Compliance Officer will provide oversight of all compliance-related activities across the Company's departments and programs in the applicable region. The Regional Compliance Officer will report to the Head of Compliance.
The Regional Compliance Officer will be responsible for providing guidance to the applicable Regions’ business leaders and senior management team on all compliance-related matters, working with outside legal counsels when appropriate to determine risks and action plans and implementing policies and procedures to ensure consistency across the applicable Regions.
The Regional Compliance Officer reviews and evaluates compliance issues/concerns within the organization. The position ensures that management and employees are in compliance with the rules and regulations in heightened risk areas such as business ethics (bribery and corruption) and that key company policies and procedures are being followed, and that behaviour in the organization meets the company’s Code of Conduct and other underlying applicable areas of an effective compliance program.
Responsibilities
Develops and builds up the Regional Compliance function in consultation with Head of Compliance.
Develops, initiates, maintains and revises policies and procedures on a Regional level for the operation of the Global Compliance Program and its related activities to prevent illegal, unethical, or improper conduct.
Manages day-to-day operation of the Regional Compliance Program.
Collaborates with other departments (e.g. legal, internal audit, HR, etc.) to direct Regional compliance issues to appropriate existing channels for investigation and resolution.
Responds to alleged violations of applicable rules, regulations, policies, procedures, and Code of Conduct on a Regional level by evaluating or recommending the initiation of investigative procedures.
Identifies potential areas of compliance vulnerability and risk by conducting risk analysis; develops/implements corrective action plans for resolution of problematic issues and provides general guidance on how to avoid or deal with similar situations in the future.
Maintains an effective compliance communication program for the region, including promoting a) use of the Compliance Hotline; b) heightened awareness of Code of Conduct and other relevant policies; and c) understanding of new and existing compliance issues and related policies and procedures.
Supports the development of an effective compliance training program, including appropriate introductory training for new employees as well as ongoing training for all employees and managers.
Monitors the performance of the Regional Compliance Program and related activities on a continuous basis, while taking appropriate steps to improve its effectiveness.
Works with Internal Audit to perform compliance audits in the Region.
Advises and consults on transactional matters, emerging risk areas, areas of policy or procedural gaps or ambiguity, or areas of increased enforcement attention.
Is responsible for the local execution of Third-Party Management and KYC (Know Your Customer) program.
Maintains current knowledge of laws and regulations in the Region, keeping abreast of changes as they take place.
Is responsible for Transparency Reporting for all applicable countries within the region to ensure compliance with the federal Physician Payment Sunshine Act and other applicable transparency reporting requirements in the Region.
Chairs the Sponsorship & Donation Committee that reviews global requests for educational grants, charitable contributions and donations in the region.
Supports the Trade Compliance function in the region.
Reviews possible Merger & Acquisition activities in the region.
Qualifications -
University degree in finance or legal.
Minimum of five years of experience in compliance function with preference to healthcare industry.
Experience in developing, implementing and executing Compliance programs on Anti-bribery and Corruption, Competition Law, Conflicts of Interest, Fraud, Export controls.
Experience in the design and implementation of compliance metrics.
Experience supporting senior management, crafting creative solutions and integrating multiple business objectives.
Strong communication skills and proficiency in English. Any other Regional languages considered a benefit.
Must possess very strong business judgment and the ability to understand and respond to business issues and needs.
Strong commitment to high standards of integrity, professionalism, loyalty, honesty, respect, and business ethics is required.
Must be able to work independently, and handle both small and large matters with equal effectiveness and enthusiasm.
Must be able to thrive in a fast-paced environment with ever-changing business objectives, be willing to adapt to change, as well as being capable of driving change.
Must be willing to comply with pre-employment screening, including but not limited to, drug testing, reference verification and background check.
