Overview

The Director Assistant General Counsel role provides legal advice and counsel for hospitals and associated physician practices in South Carolina.  This role supports facilities and physician network operations, including physician contracting, employment law, and patient care related legal matters.  The ideal candidate has a blend of health care regulatory and transactional experience with a special focus on hospital operations.

 

Qualifications
  • Education: 4 Year / Bachelor's Degree, required. Undergraduate Bachelor's degree from a recognized college or university required.  Juris Doctorate Degree from an accredited law school, required.
  • Experience: 7+ Years experience in the Practice of Law, required. Previous experience in law firm or an in-house healthcare setting, preferred. License/certifications:  Admission to the bar of at least one state or the District of Columbia, required. Admission to the bar of South Carolina, preferred.
  • Additional skills required
    • 7+ years' experience in the practice of law
    • Significant healthcare experience in hospital operations
    • Regulatory healthcare experience 
    • Experience with the Anti-Kickback Statue (AKS), the Stark Law, and other regulations
    • Significant healthcare transactional experience, including physician employment, independent physician arrangements, call director and medical director arrangements
    • Familiarity with federal and South Carolina patient care regulations
    • Experience in advising medical staffs and hospital boards.
    • Excellent communication skills.
    • Ability to handle unusual, demanding and unrelated tasks and strong organizational skills.
    • Speed to Market: Effectively works in a fast-paced work environment to deliver results
    • Problem Solving: Strong analytical, critical thinking and creative problem-solving skills.
    • Judgment: Demonstrated ability to act independently on information and make decisions that achieve optimal results.
  • Additional Skills/Requirements (preferred): Experience with physician networks, EMTALA and employment law.
Responsibilities

         Primary legal support for hospitals located in South Carolina and associated integration efforts

         Legal support for physician practices located in South Carolina

         Create an environment that supports and respects diversity to promote creative problem solving.

         Respects and follows organizational policy and procedure, including rules of conduct.

         Responsible for helping to achieve goals defined by People & Culture and Novant Health leadership.  Constantly monitor progress and metrics toward meeting defined goals.

         Supports growth, development of initiatives, and overall performance of strategy. Demonstrates dedication to meeting the expectations and requirements of stakeholders.

         Work alongside team members to monitor and evolve practices for continuous process improvement.

         Assist with specialized legal areas such as joint ventures, ambulatory surgery centers and other market/specialty specific programs and strategic partnerships;

         Develop policies, practices, and procedures that have a significant impact on the [business?]

         Provides reliable and well-researched advice on all manner of matters

         Advises on specific healthcare issues such as HIPAA Privacy Rule, the False Claims Act, the Anti-Kickback statute, regulatory [HVC1] and confidentiality issues.         Reviews and prepares agreements and contracts

         Assists in the development of new policies, procedures and forms for the organization.         Maintains professional competency, according to department policies, procedures, and protocols.
