The Associate Counsel, Environmental & Regulatory​​​​​​ will report to the Managing Counsel – Environmental & Regulatory and will use their knowledge and experience in HSE and regulatory law to assist and support the research, reporting, management, and handling of legal matters in the HSE & Regulatory practice group of a large, publicly-traded, integrated midstream and downstream energy company.
Responsibilities May Include:
Conducting legal research (federal and state equivalents) on Clean Air Act, Clean Water Act, CERCLA/Superfund, EPCRA, NEPA, TSCA, Endangered Species Act, Oil Pollution Act, Safe Drinking Water Act, Solid Waste Disposal Act, and in connection with RMP and OSHA matter.
Managing, monitoring, and representing the company’s interest in multi-party Superfund Site activities, including participating in conference calls and meetings with governmental agencies and other parties (PRPs) and associated reporting.
Investigating facts underlying environmental/regulatory matters, including CERCLA/Superfund and Fuels/Renewable Fuels registration, for drafting and preparing responses to governmental agencies.
Maintaining past and current reportable matters for quarterly SEC Reporting of Legal Proceedings.
Working with External Reporting in completing and submitting RCRA and UST, etc. financial assurance filings to various states and federal environmental agencies.
Staying abreast of trends and developments in environmental and regulatory regulations, case law, and settlements within the industry.
Providing legal counsel, advice, and support for environmental, health and safety operations and regulatory compliance of refining facilities.
Supporting regulatory inspections and regulatory enforcement action discussions and proceedings with state and federal regulators that have jurisdiction over environmental, health and safety issues.
Providing legal counsel and guidance across regulatory function including a wide variety of permitting and enforcement matters involving land use, air, and water quality and supply as well as a variety of other operational permitting activities at the county, state, and federal levels in multiple jurisdictions. Experience in managing issues that implicate the Clean Air Act and its many components, including but not limited to, “Quad O” and some experience dealing with regulators preferred.
Support during Crisis Management situations and willing to gain experience with incident investigation and overall crisis management facilitation.
Work with Right of Way Group on Land Access Agreements.
Required Qualifications:
Legally authorized to work in the job posting country
J.D. from an accredited law school
Currently licensed in good standing to practice law in relevant jurisdiction(s)
2 or more years of experience and general knowledge of environmental and regulatory law, terminology, and clauses associated with energy industry
Working knowledge of one or more of the following: Clean Air Act, Clean Water Act, CERCLA/Superfund, EPCRA, NEPA, TSCA, Renewable Fuel registration, Endangered Species Act, Oil Pollution Act, Safe Drinking Water Act, RCRA, Slid Waste Disposal Act or OSHA
Proficient in Microsoft Office products (Microsoft Word, Excel, PowerPoint, SharePoint, and document comparison software)
Preferred Qualifications:
Experience with compliance counseling, advising on environmental matters in corporate and commercial transactions, due diligence, and interactions with applicable regulatory agencies. Subject matter familiarity should include air emissions, industrial and hazardous waste, water quality, wetlands, endangered species, contaminated properties and other state and federal environmental regulatory requirements
Strong individual initiative, discipline and commitment to superior performance, customer service, and continuous improvement
Superior negotiation, presentation, collaboration and diplomacy skills with excellent judgment and discretion
Ability to manage and prioritize assignments effectively which may be broad in scope and complexity, and which requires collaborative work with a team of highly experienced lawyers, as well as employees in different departments and/or with varying degrees of seniority
Excellent written and oral communication skills
Ability to work well under pressure, meet deadlines and function independently without extensive supervision
Ability to learn quickly and apply company policies, procedures, and industry practices
Experience in oil & gas, refining, energy, or petrochemical industries
