We're looking for people who are determined to make life better for people around the world.As Sr. Director, Counsel for Lilly Value and Access (LVA), you will join the team of attorneys that advises the Company on the pricing, reimbursement, access, and distribution of Lilly's products in the U.S. This role will work closely with others on the LVA legal team, as well cross-functionally with other attorneys, including those in brand, medical, and other specialties, to support various aspects of the development and commercialization of Lilly's products. This role will be primarily responsible for:
- Advising on the Company's arrangements and interactions with pharmacy benefit managers, health plans, employers, and other payers.
- Negotiating, drafting, and/or reviewing agreements with these entities, including market access agreements, value-based agreements, etc.
- Advising on the Company's compliance with government price laws, including state drug price reporting requirements, the Medicaid Drug Rebate Program, FSS/VA, the 340B program, etc.
- Contributing as a key member in U.S. Affiliate governance meetings to provide legal advice on customer engagement and/or contracting strategies.
- Partnering closely with Lilly's Contract Management & Analytics (CMA) group to advise on contract administration matters, including evaluating audit findings and managing dispute resolution and settlements.
- Collaborating with legal and brand colleagues to advise on pricing, reimbursement, and access strategies related to new products.
- Negotiating, drafting, reviewing, and providing guidance on agreements with other customer segments, including group purchasing organizations, pharmacies, wholesalers, and/or patient affordability vendors.
- Collaborating cross-functionally with other attorneys on issues related to FDA promotional laws, the intersection between medical and marketing personnel, planning and use of real world evidence/data, federal healthcare program compliance, and privacy.
- Reviewing and providing counsel on internal and external communications, in particular those related to pricing, access, and affordability topics.
- Preparing and delivering practical and pragmatic training to the organization related to relevant legal topics, contracting and risk mitigation.
- Advising on the design, implementation, and execution of patient support, affordability, and/or assistance programs.
- Collaborating with Government Affairs and Public Policy colleagues on issues impacting pricing, reimbursement, and access.
- Engaging, as needed, with government or regulatory agencies to educate on the implications of specific policies or laws.
Basic Qualifications:
- JD degree and currently admitted to the bar in at least one U.S. jurisdiction
- Must be eligible to be admitted to the bar in Indiana under Indiana Admissions Rules
- Minimum of 5 years as an attorney practicing health care or pharmaceutical contracting, fraud and abuse counseling, pharmaceutical pricing or related area.
Additional Skills/Preferences:
- Preference for in-house legal experience, ideally with a global pharmaceutical or biotechnology company, or advising global corporation clients at a law-firm, or some combination of the two
- Experience with fraud and abuse laws, particularly in the context of payer and PBM agreements.
- Experience with competition, pricing, reimbursement, and access issues as they pertain to the pharmaceutical industry.
- Knowledge and understanding of government pricing programs, including the Medicaid Drug Rebate Program, 340B, the Federal Supply Schedule, etc.
- Excellent oral and written communication skills with a demonstrated ability to present complex information accurately and concisely.
- Strong background demonstrating ability to influence people and outcomes.
- Demonstrated leadership and effectiveness in working with senior leadership.
- Good judgment and a meticulous level of attention to detail.
- Strong analytical skills.
