PURPOSE: Responsible for risk management, loan servicing, and collection of all delinquent accounts, including potential fraud issues, ATM collection exceptions, NSF checks, returned items, courtesy pay overdrafts. Manage CDC FCU’s compliance programsby ensuring compliance with required regulations, applicable laws, and approved policies and procedures. Provide management oversight by providing leadership and guidance. Contribute to the achievement of CDC Federal Union’s Strategic Goals.
ESSENTIAL DUTIES & RESPONSIBILITIES
Collections/Consumer Loan Servicing
- Provide management oversight to the collections department while controlling delinquency and recovery activities to minimize losses.
- Perform special projects as assigned.
- Interface with repossession agents and attorneys on collection accounts to mitigate losses. Including, administer small claim actions.
- Maintain records of collection activity - charge offs, bankruptcies, workouts, modifications and recovered collections.
- Prepare monthly collection/management reports by the 5th of each month.
- Provide management oversight to loan servicing by staying abreast of lending reviews and reviewing reports for perfected liens.
Negative Deposit Accounts
- Research and collect shortages and/or deficiencies generated by ATM overdrafts, debit card and courtesy pay overdrafts, and bad checks in accordance with the established Negative Balance Accounts Procedures on the intranet.
- Restrict ATM access until the exception is cleared. Review accounts with excessive ATM exceptions for possible permanent restriction.
- Review accounts with excessive NSF and returned deposits for possible closure. Submit accounts with unresolved negative balance due to returned check deposits to authorities for possible criminal action.
- Restrict courtesy pay privileges for members who abuse the privilege.
General Risk Management
- Stay abreast of regulations, rules, laws, and other compliance issues relevant to the credit union industry.
- Ensure all regulatory updates or changes are communicated in a timely manner to the appropriate areas of credit union operations.
- Serve as a resource for compliance-related queries.
- Follow up on exam/audit findings to ensure exceptions and procedures are updated as required.
Operational Risk Management
- Perform routine BSA/AML, Patriot Act and OFAC duties utilizing credit union approved software.
- Work closely with IT management to ensure member data security protocols comply with FFIEC standards.
- Review all marketing materials and other correspondence as required, to ensure compliance with applicable laws and regulations.
- Performs background research on member complaints filed through the NCUA portal and provides written conclusions to the CEO and Supervisory Committee as prescribed under NCUA guidance.
PERSONNEL ADMINISTRATION
- Responsible for managing, monitoring, coaching, counselling, and evaluating job performance of collections staff in accordance with CDC FCU's policies, procedures, and compliance with applicable laws.
- Ensure personnel policies and procedures and salary administration guidelines are followed to ensure a fair and equitable work environment.
- Responsible for interviewing/hiring; training; planning/assigning work; rewarding and addressing complaints/resolving problems.
- Accomplish goals through communication of expectations to staff.
- Lead by example.
MISCELLANEOUS
- Investigate and collect losses resulting from new account fraud, check kiting, etc.
- Follow all credit union policies, procedures, security guidelines and regulatory and policy compliance requirements, i.e., Fair Debt Collections Practices Act, Bank Secrecy Act (BSA), Office of Foreign Asset Control (OFAC), and Anti-Money Laundering (AML) Regulations, and all other compliance related policies.
- Cultivate and maintain appropriate relationships with members, coworkers, vendors and the community in which we serve.
- Develop and maintain network with other credit union professionals.
- Maintain working knowledge of all applicable computer programs and systems.
- Handle all other duties as assigned.
KNOWLEDGE/EXPERIENCE/SKILLS & ABILITIES
- Bachelor’s Degree in related field or an equivalent combination of education and experience
- Must have 5 years’ collections/risk management experience.
- Must have a minimum of 2 years supervisory experience.
- Must work independently requiring little supervision.
- Able to make logical decisions in a timely manner.
- Must be organized and detail oriented.
- Must be computer literate.
- Must be able to learn and adapt to new technologies.
- Must possess good communications skills, both verbal and written.
- Must be proficient in problem solving and conflict resolution.
- Must have a personality conducive to a collection’s atmosphere.
- Must be capable of reading and understanding all sections of the credit union's Policy Manual with particular emphasis on the Loan Policy.
- Must be able to report observable patterns or trends in credit union delinquencies, which may result from existing loan policies.
- Regular and predictable attendance.
- Must be bondable and have no felony convictions.
