The DSS Accountability Office (DSS AO) is responsible for protecting the integrity of social services programs administered by the New York City Department of Social Services (DSS). Within DSS AO, Referrals and External Affairs' (REA) mission is to prevent, detect and report public assistance fraud and misuse of agency funds by conducting investigations of individuals and groups who attempt or commit fraudulent acts that violate the benefit programs administered by HRA/DSS/DHS. REA accomplishes its mission by working cooperatively with federal, state, local law enforcement and prosecutorial entities. REA manages highly specialized investigations to detect and prevent the loss of program funds administered by the Agency and the City of New YorkReferrals & External Affairs is recruiting for (1) Executive Agency Counsel M II, to function as the Director of Prosecutions & Administrative Hearings, who will:
- Serve as the legal advisor on complex/significant cases identified for criminal, administrative sanctions and recommendations on questions of law, fact, and administrative policy. Assist the REA Executive Office in drafting important and difficult legislation and policy statements.
- Use online legal research applications to conduct complex legal research and draft clear and concise legal documents, such as motions, briefs, memorandums, resolutions, and legal agreements for REA.
- Oversee teams providing direction and assistance, especially for extremely complex and sensitive investigations that require convergence with management and other law enforcement agencies. Ensure supervision and training of staff in the preparation and presentation of criminal and administrative proceedings. Provide legal direction and advice on matters of case strategy.
- Manage relationships effectively with five New York City District Attorneys' Offices and the Office of the Temporary and Disability Assistance (OTDA). Maintain contact with several internal/external units/agencies involved in the criminal, civil or administrative litigation of REA cases to ensure the timely processing of new or returned cases. Ensure case content conforms to federal, state, city laws and social service guidelines necessary for successful adjudication, and that Agency claims on monies from the cases are recognized and satisfied.
- Meet with supervisory staff to discuss case processing, tracking, outcomes, and any issue(s) that require immediate attention. Identify and resolve problems with subordinate staff and investigative procedures to meet deadlines and ensure maximum operational productivity; measure outcomes and develop policy/procedure to improve outcomes.
- Conduct performance review and complete evaluations for subordinate staff. Provide staff development/training on Agency policies, and keep staff informed of new procedures.
Minimum Qualifications:
Admission to the New York State Bar; and four years of recent full-time responsible, relevant, satisfactory legal experience subsequent to admission to any bar, eighteen months of which must have been in the supervision of other attorneys, in an administrative, managerial or executive capacity, or performing highly complex and significant legal work.
Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.
