GENERAL PURPOSE OF THE JOB

This position is an integral member and leader of the Employment Investigations team for assigned segments of DaVita’s business, providing subject matter expertise in workplace investigations and teammate (employee) relations. This position is responsible for leading workplace investigators in conducting reviews of internal complaints of policy violations, including discrimination, harassment, retaliation, and workplace violence. This position reports to the Vice President, Associate General Counsel, Labor, Employment, and Investigations, and partners closely with operations, field people services, legal, compliance and Teammate Relations Advisors.

ESSENTIAL DUTIES AND RESPONSIBILITIES

The following duties and responsibilities generally reflect the expectations of this position but are not intended to be all-inclusive.

  • This role helps the Village comply with a variety of labor and employment laws through leading a team, creating and implementing processes, and being a deep expert that provide advice and guidance to high level executives.
  • Leads a large team of individual contributors and people leaders all focused on helping the Village comply with labor and employment laws; acts a an expert on a variety of labor and employment laws; conducts reviews or appeals of corrective actions; creates and implements programs and policies to comply with labor and employment laws
  • Leads a team of workplace investigators in reviewing and investigating complaints regarding inappropriate behavior, including but not limited to discrimination, harassment, and retaliation.
  • Conducts investigations and reviews of concerns regarding high-level and executive leaders throughout the company.
  • Leads projects to improve the performance and efficiency of the Employment Investigations function.
  • Leverages technology innovations to revolutionize the way Employment Investigations are handled at the company.
  • Provides consultation, guidance and coaching to supervisors, managers and People Services Managers (PSMs) to address teammate behavior and performance concerns; provides guidance and assists with the development and delivery of appropriate feedback or corrective/disciplinary actions
  • Partners with legal team to prepare strategy and responses to third-party EEOC, OFCCP, and other governmental charges and requests as well as threatened litigation; participate as needed with legal cases
  • Partners with field People Services on as-needed basis, keeping field PS and the business appropriately informed and involved during Employment Investigations work
  • Works with field People Services and business managers to appropriately address high risk employment issues, reports findings and proactively address trends impacting the business; acts as subject matter expert for a variety of employment related training developed by PSMs
  • Provides guidance and assists with delivery of Performance Improvement Plans or other corrective/disciplinary actions for sensitive cases
  • Maintains required documentation within case management system (EthicsPoint), including intake, investigative notes, supporting documents and final reports
  • Demonstrates advanced knowledge of the laws and policies affecting the Employment Investigations processes, programs and/or strategies; monitors changes in laws and policies; independently develops initiatives to continuously align with legal and regulatory guidelines
  • Leverages analytical findings of investigations data to identify organizational, functional, and systemic trends
  • Ability to travel domestically up to 20% of time (can be unpredictable/unplanned)

MINIMUM QUALIFICATIONS

Education, licenses, certifications, and experience required to fulfill the essential duties, include computer skills as required.

  • Extensive experience addressing employee underperformance and behavioral problems required
  • Bachelor’s Degree and Juris Doctorate required.
  • Five (5) or more years of HR or related legal experience; three (3) years of which must be with employee relations and investigations responsibility
  • Certified Professional (PHR) or Senior Professional (SPHR) in Human Resources preferred
  • Large, multi-site company experience preferred
  • Subject matter expert in one or more specialized regulatory areas (e.g. EEOC, ADA) or TMR areas of expertise preferred

Fluent in the written and verbal skills necessary to successfully perform the essential functions, duties, and responsibilities of the position.

PHYSICAL DEMANDS

Physical requirements can vary. These must be reviewed with management. However, in general, the position requires the following physical activities:

  • Ability to lift minimum of 2 pounds to a maximum of 15 pounds unassisted; able to sit for extended periods of time with some standing, stooping, walking, stretching, reaching, lifting; moderate range of body motions
  • Ability to hear and interact by phone, in person, and in presentations clearly and efficiently
  • Ability to use computer and all peripherals as needed to meet goals
  • Vision adequate to perform essential duties and responsibilities of position.

WORK ENVIRONMENT

Level III - Moderate noise (examples: business office with computers and printers, light traffic)

No required tasks involve greater exposure to blood, body fluids or tissues than would be encountered by a visitor. The normal work routine involves no exposure to blood, body fluids or other hazardous conditions.

Salary/ Wage Range

$110,100.00 - $161,700.00 / year

Compensation for the role will depend on a number of factors, including a candidate’s qualifications, skills, competencies and experience and may fall outside of the range shown.
