What You'll Contribute
The Director, Associate General Counsel (Risk Mitigation) will be responsible for providing expert legal advice, managing lawsuits and threatened lawsuits, conducting internal investigations, engaging in Risk Mitigation initiatives, and protecting the company's legal interests in court and arbitration, and more as detailed below.
What You'll Do
Description of Time Spent
• Consumer, class action, and commercial litigation defense, including case assessment, discovery, subpoenas/civil investigative demands, preparation/review of pleadings, and dispute resolution tools up to and including trial. Manage the activities of Sallie Mae Bank and its affiliates in court and arbitration, including litigation and settlement strategies, as well as effective management of outside counsel. Lead Risk Mitigation initiatives, identifying risks and opportunities to prevent or reduce litigation against the company, including by identifying areas for process improvements and interfacing with business clients. Conduct internal investigations. 45%
• Assists in legal department operations, including but not limited to: (a) risk management and internal controls design/testing, expected for a regulated bank, (b) managing and/or providing advice on various policies, procedures and guidelines, and (c) acting as liaison to other internal departments on various transactions and/or other projects. 25%
• Assists in managing corporate insurance portfolio, including but not limited to: (a) advising key business partners on the company's insurance policies; (b) managing the annual process for obtaining and renewing insurance coverage, including insurance applications and underwriting meetings; and (c) overseeing insurance claims and potentially insured expenses. 15%
• Tasks related to eDiscovery, litigation hold compliance, and record retention. Draft, revise, and issue litigation holds as needed. Support company-wide efforts on data retention and defensible data destruction. Partner with IT on relevant issues and initiatives. 15%

What You Have
Minimum: Indicate minimum education, skills and experience required.
• Juris Doctor (J.D.) degree from an accredited law school and a valid license to practice law. Candidate must be eligible to obtain the necessary certification(s) to practice law as in-house counsel.
• Proven track record in providing legal advice, managing litigation, and risk management.
• Litigation Expertise: 7+ years of consumer and/or class action litigation experience within an in-house legal department or law firm, including experience assessing legal, reputational, and operational risk in difficult and high-stakes situations under acute time pressure.
• Strong understanding of legal framework in consumer financial services industry, including but not limited to FDCPA, FCRA, TCPA, TILA, ECOA, and state consumer protection statutes.
• Excellent communication, negotiation, and analytical skills.
• Ability to collaborate effectively with cross-functional teams and influence decision-making.
• Exceptional leadership and communication skills.
• High level of integrity, ethics, and professional judgment.
Preferred: Indicate "nice to haves" regarding education, skills, and experience.
• Relevant substantive experience in bankruptcy law and/or advising business partners on litigation recovery strategies.
• Experience with legal operations, legal technology solutions, and project management.
• Experience with legal technology platforms, including Relativity Legal Hold and Thomson Reuters Legal Tracker.
