Archer Western, a member of The Walsh Group, is currently seeking a Commercial Manager at our Miami Signature Bridge Project located in Miami, FL.
Participate with ownership and management in strategic business development and client relationships. Contribute to the go/no go process by providing guidance from a legal perspective regarding owner reputation and contract risks. Provide strategic guidance on commercial / financial risks and opportunities. Provide management of day-to-day project commercial issues, finances and/or contracts. Provide support to Project Leader through understanding of contracts, drafting key project
correspondence and focusing on how to protect company/project long term interests. Provide feedback to ownership and management regarding the avoidance of pitfalls and lessons learned. Develop
strategies to reduce risk in procurement and in performing projects.

Commercial Manager will provide strategic guidance on commercial and financial risks and opportunities to a project or multiple projects within a region, including management of day-to-day project commercial issues, finances, and contracts, and support of Project Leaders in drafting key project correspondence and developing strategies to reduce risks in project performance. Areas and responsibilities include but are not limited to:
- Provide strategic consultation to avoid claims, company exposure, and developing positions to maximize recovery.
- Master understanding of Owner contract and sub/vendor agreements to keep project in compliance with contractual provisions and industry standards, including notice procedures, contractual risk allocation, contractual remedies, and dispute resolution procedures.
- Provide support to Project Leader in the negotiation and administration of complex subcontract, professional services, and purchase order agreements.
- Gain knowledge and understanding of project finances and accounting and provide strategic guidance reducing risks and maximizing opportunities.
- Draft project correspondence to be sent to the Owner, subcontractors/suppliers, and other third parties.
- Provide strategic guidance to Project Leader on project performance issues, including subcontractor default, bond and mechanic lien claims, owner disputes, and contract compliance.
- Project management of project controls to ensure all corporate/project processes and procedures are implemented.
- Advise in the identification and preparation of claims in close coordiantion with project management team and corporate legal department.
- Provide support to corporate legal department and outside counsel as needed for pending commercial litigation matters.
- Bachelor or Juris Doctorate degree
- Juris Doctorate from an accredited law school preferred but not required
- 5-10 years of practical relevant experience
- Construction industry experience preferred
- Strong written and verbal communication skills
- Strong organization skills with attention to detail
- Ability to assess potential risks, benefits, and consequences of decisions
- Willingness to accept greater responsibility and challenge existing process
- Strong desire to acquire new skills
- Travel as necessary to attend meetings, conduct trainings, audits and investigations
- Required to work in-person at one of the regional project offices or Project Office
