Description of Job
Hybrid. This position will perform telework as well as report to a variety of in-person meeting locations throughout the state as needed, with a minimum of one in-office day per month.

About this Unit:
The position is located within the Colorado Department of Human Services (CDHS), Behavioral Health Administration (BHA) which leads and promotes the State's behavioral health priorities, ensures that behavioral health services respond to the changing needs of communities, monitors State and local data, and continuously evaluates State efforts. In collaboration with other state agencies, the BHA is accountable for the delivery of behavioral health services in Colorado. It bestows a streamlined and efficient government approach to support quality care while minimizing the burden to providers so that they can focus on service delivery. The BHA is responsible for behavioral health policy development and effective collaboration with cross-sector partners working in and around the behavioral health system and along the continuum from prevention to treatment and recovery. The BHA works in partnership with State agencies to reduce bureaucracy and fragmentation.
The Policy and External Affairs Division's role is threefold: 1) to promote positive external relationships and bring the voice of stakeholders to the BHA which includes coordination and support to the BHA Advisory Council-a statewide and broad stakeholder council that is part of the BHA governance and which has multiple working groups; 2) to design strategy and tactics as well as be the day to day communications arm of the BHA-supporting internal, external and cross-agency communication; 3) Lead policy and legislative efforts of the BHA which includes intersecting policy and legislation for behavioral health across multiple state agencies and includes promulgating administrative rules. The policy section oversees policy development, rule development, communications, and grant writing. The section works closely with CDHS legislative liaisons, communications directors, the audit division, and the State Board of Human Services to ensure coordinated external relationships. This section further works most closely with the Colorado Departments of Health Care Policy and Financing, Public Health and Environment, and Regulatory Agencies on the development of policy and rule, licensing, and compliance monitoring. However, as the role of the BHA changes, policy advisement may expand to include more state agencies with behavioral health programming.
About this Position:
This position requires subject matter expertise in community behavioral health systems and the laws and regulations that are needed in order to support the BHA in its overall mission. This position supports the policy leadership in making interpretative decisions on how to best advocate and promote behavioral health services in Colorado. This position supports technical assistance in policy-making, regulatory, and legislative strategic planning as directed by leadership. This promotion provides detailed research, analysis, and initial drafts of policy, legislation, and administrative rules that incorporate best practices, improved standards of care, and specific strategies to effectively implement behavioral health services. This position works closely with the Quality and Standards Division as well as the Statewide Programs Division within the BHA; coordinating strategy, policy design, and administrative rules to enhance behavioral health quality. This position uses judgment and resourcefulness while relying on established theory and professional standards, to make expert opinions and establish how programs or systems are implemented and monitored through regulations.
The position includes material development, analysis, and draft responses to external partners in support of the Policy & External Affairs Division's diverse and broad stakeholder engagement in the process of policy, legislation, and rule promulgation. The position also is responsible for supporting revisions and incorporation of stakeholder feedback within rapid timeframes to support the Deputy Policy Director and Policy Director in legislative priorities and external affairs. The position is asked to coordinate policy, legislation, and administrative rule development with other state departments and divisions to support the BHA's statewide strategic vision. This may include shared drafting, coordination of policy and legislative efforts, and integrated administrative rule. The position also supports the Deputy Policy Director and Policy Director in supporting the State Board of Human Services review of policy and administrative rules.
Following the passage of legislation, the position coordinates the implementation of legislation working across divisions within the BHA and across agencies. Similarly, this person supports the Deputy Policy Director and others within the division in responding to requests from other Departments and stakeholders on behavioral health program implementation and Behavioral Health regulation (primarily 2-CCR 502-1 and 2 CCR 502-5). This position provides materials and technical assistance to other state Departments and public stakeholders on these regulations and policies and ensures other state Departments are represented on Boards and Commissions. The position demands skill and expertise in the development, evaluation, and recommendation of major regulatory and program determinations that have influence at a state level, including regulatory and program determinations that may affect multiple state Departments, such as HCPF, DPS, DORA, and CDPHE. The position is expected to support the Deputy Policy Director and Policy Director in the analysis of operating policies, guidelines, and work processes inside as well as outside the administrative unit and create strategic approaches to particular circumstances.
Summary of Job Duties:
Policy & External Affairs materials development:
  • Support material development, conduct research, and provide responses (inclusive of initial drafts), as assigned, on a wide variety of legislative and regulatory adjacent requests (e.g., memoranda, technical assistance, fiscal notes, rules, regulations, etc.)
  • Draft summaries and support information dissemination on new initiatives and trends to internal and external stakeholders
  • Ensure Policy & External Affairs Division input and presence at internal and external meetings, as assigned.
  • Provide draft analysis of fiscal and program data by breaking down the problem into parts, examining these parts, and reaching conclusions that result in processes that promote behavioral health services in Colorado. The analysis requires the application of public administration theory, principles, professional standards, and knowledge of behavioral health policy at the federal, state, and local levels.
  • Support the Deputy Policy Director in consultation with chairs of BHA Boards and Commissions (including the Advisory Council) on statutory and regulatory questions, considerations, and issues assisting them in meeting the statutory requirements, coordinating membership changes, and training support staff in basic rules for agendas, minutes and other membership communications.
  • Support material development, coordination of sessions, and training sessions of community partners including, other state departments, law enforcement and treatment providers, compliance specialists, and policy professionals on the implementation and protocols related to involuntary holds.
  • Drafting Behavioral Health Rules and implementation of technical assistance of the same
  • Stakeholders and material development for stakeholders for all rules promulgated by the Policy & External Affairs Division within the BHA
  • Legislative, Policy, and Rule Drafting and Implementation support
Behavioral Health Rules Drafting and Technical Assistance:
  • Provide research, analysis, and synthesis of best practices on administrative rules for the Deputy Policy Director.
  • Draft administrative rules based on established theory and standards of care.
  • Develop training and technical assistance materials to support other state agencies, external partners, and internal BHA personnel with the interpretation of administrative rules.
  • Support monitoring of compliance with administrative rules as directed by the Deputy Policy Director.
  • Support the development of materials for Board Packets and any research or additional materials to support justification for Deputy Policy Director presentations to the State Board.
  • Create briefs for the Deputy Policy Director on how administrative rules affect the BHA, other state Departments, and other community partners.
  • Makes revisions to rules based on feedback from the Board and ensures that content expertise is present as needed.
  • Support maintenance of the calendar of rule review and revision for the BHA, scheduling and managing material development for stakeholder feedback, preparing rule packages, summarizing committee reviews and clearance processes, and ensuring all public notice requirements are met.
  • Coordinate with the State Board of Human Services Administrator to ensure rule packet completions and coordinate scheduling with the State Board of Human Services.
  • Seeks out content expertise both within and outside the BHA and drafting rules to satisfy a variety of stakeholders and best practices.
  • Develop routine meetings and processes for working with other state agencies on administrative rule development to support integrated and consistent rules across agencies on core topics for BHA across the agency.
  • Review statutes to ascertain legislative intent and prepare materials for the Deputy Policy Director's interpretation of intent in rule, seeking consultation from the Office of the Attorney General as needed.
  • Ensures that rules are aligned with other state Departments, including CDPHE licensing rule and DORA scope of practice rule.
  • Provide training for stakeholders and BHA staff in statutory provisions affecting BHA and BHA.
  • Draft response to questions from the State Board of Human Services on the rationale and content of the rule

Legislative, policy and rule review, analysis, and research:
  • Coordinate feedback across all BHA Divisions and other state Departments on the Department's fiscal and policy analysis of new legislation. Provide research, analysis, and draft recommendations to the Deputy Policy Director and Policy Director.
  • Provide research, analysis, and drafting of statutory and regulatory changes, policies and procedures, and functions.
  • Support the Deputy Policy Director and Policy Director with an analysis of how new programs or changes to programs may impact regulations, policies, or legislation.
  • Support BHA divisions and other state agency personnel to understand the impact of legislation, regulation, and administrative rules.
  • Support consultation on contractor and agency compliance with rules, statutes, and contracts to assist the Compliance Administration Team and to Program Managers.
  • Completes draft compliance and licensing reviews and technical assistance as needed to both internal and external partners.
  • Review, research, and draft summaries of federal and state laws and regulations, including laws and regulations in other states, and advise the Deputy Policy Director and Policy Director on implications and potential opportunities to enhance Colorado's behavioral health system.
  • Provides interpretation and complex analysis of statutory, regulatory, and policy impacts. Interprets and disseminates information.
  • Tracks for Deputy Policy Director and Policy Director completion of legislative reports ensuring adequate time for editing and clearance.
  • At the end of each legislative session, draft a workplan, assignments, deadlines, and deliverables to meet newly created statutory directives for Deputy Policy Director and Policy Director.
  • Draft an annual overview of BH-related legislation for BHA staff with information on the intersection with other state agencies on core BH functions.
  • Identify relevant statutes and regulations that may support or limit a BHA initiative.
  • This position's unique level of knowledge and expertise in community behavioral health systems, laws, and regulations is utilized to edit and format legislative reports to ensure they meet statutory requirements and align with the BHA's mission and goals.
