This position is part of the team of attorneys representing State agencies in Workers' Compensation claims.
This attorney acts as defense counsel for the North Carolina Department of Transportation, and other agencies of the State as needed, in legal actions brought pursuant to the Workers' Compensation Act in the North Carolina Industrial Commission, state and federal courts.
Cases include issues from physical injury to psychological problems which may leave the State exposed to liability for years of expensive medical treatment and wage loss, vocational rehabilitation and permanent injury resulting in enormous costs to the employer for extended periods of time.
This attorney will handle medium complexity cases with minimal supervision. The attorney will also be responsible for handling criminal appeals, and any other duties as assigned by the Section Head.
This position involves extensive litigation and some in-state travel.
The North Carolina Department of Justice, led by the Attorney General of North Carolina, represents the State of North Carolina in court and provides legal advice and representation to most state government departments, agencies, officers, and commissions. The Department also represents the State in criminal appeals from state trial courts, and brings legal actions on behalf of the state and its citizens when the public interest is at stake.

The salary grade for this position is LG07. State employees are encouraged to apply for positions of interest even if the salary grade is the same as, or lower than, their current position. Please detail ALL work history including non-state service experience. If selected for this position, a new salary will be recalculated taking into consideration the quantity of relevant education and experience, funding availability, and internal equity. Based upon these factors, a pay increase MAY or MAY NOT result.

Knowledge, Skills and Abilities / Competencies:
  • Considerable knowledge of case, statutory, regulatory, and common law.
  • Considerable knowledge of judicial and quasi-judicial procedures and the rules of evidence.
  • Ability to conduct civil or criminal litigation.
  • Ability to interpret and apply constitutional provisions, statutes, administrative regulations, court decisions, and other precedents.
  • Ability to analyze facts, evidence, and legal instruments.
  • Ability to express conclusions and arguments clearly and logically in oral and written form.
  • Ability to maintain effective working relationships.

Minimum Education and Experience Requirements:

Licensed to practice law by the North Carolina State Bar and one year of professional legal experience. NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.
