Job Description
This is vital position in the Special Education Section of the Utah State Board of Education (USBE). It is a licensed-level job reporting to an Assistant Superintendent or Director. Dispute Resolution specialists ensure that federal (due process hearing, state complaint, and mediation) and state (Individualized Education Program (IEP) facilitation) laws are followed and that interested parties can access and apply the procedural safeguards of the Individuals with Disabilities Education Act (IDEA). They are also members of the Special Education team helping to implement the USBE policies and programs aimed at improving the compliance and services and supports of local education agency (school district and charter school) educators across the state. This job requires a Juris Doctorate is unique to the USBE.
Principal Duties
The Special Education Dispute Resolution Specialist:
  • Implements, new and/or changes to existing, policies and procedures, laws or regulations
  • Accepts requests from LEAs staff, parents and community members to access Special Education Dispute Resolution options
  • Assigns hearing officers, complaint investigators, mediators and IEP facilitators and ensures they provide assigned services within applicable timelines
  • Ensures corrective action from due process and complaint findings is provided in a timely and adequate manner
  • Provides LEAs staff, parents and community members with technical assistance about Special Education legal requirements and best practices, when applicable
  • Collaborates with other State agencies to ensure the rights of students with disabilities are provided for
  • Provides professional learning (largely related to required corrective action) to LEA staff and other stakeholders regarding the compliant implementation of the Special Education program
  • Writes or drafts technical reports, articles or related material based on legal information, research, and best practice
  • Organizes meetings, conferences, or workshops
  • Collaborates with other USBE specialists to accomplish agency goals
  • Collaborates with and provide technical assistance with the Utah Parent Center and private parent consultants
  • Other tasks as assigned

The Ideal Candidate
The ideal candidate for this position has:
  • A Juris Doctorate degree
  • At least three years of legal experience related to Special Education policies, procedures, and practices
  • Experience providing Special Education Dispute Resolution services
  • Experience developing and providing professional learning based on adult learning theory
