Primary Function:
Labor, Employment, Compliance Corporate Counsel will be responsible for providing labor and employment related legal support and guidance to the employees of Walsh and its affiliates. Labor, Employment, Compliance Corporate Counsel will serve as a general labor and employment and compliance resource for Walsh management to help ensure consistent employment and compliance practices that align with Walsh's values and the applicable laws and regulations to our work.
ResponsibilitiesThis position will serve as a general employment practices and compliance legal resource for the organization and employees providing hands-on advice, counsel and support. Responsibilities include but are not limited to:
- Stay abreast of legislation, regulations, judicial developments, and government enforcement activities relating to employment related laws and regulations and provide effective counsel to ensure compliance.
- Effectively manage outside counsel and develop litigation strategies designed to achieve efficiency and reduce cost.
- Represent the organization with respect to all administrative charges filed against it with the EEOC, NLRB, and state and local administrative agencies, including drafting position statements.
- Support and advise Human Resources and Walsh management on employee related matters including hiring, leaves of absence and accommodations, discrimination, employee relations, discipline, termination, internal investigations and wage and hour compliance.
- Assist and coordinate with Human Resources in drafting and revising policies and designing and implementing internal processes to protect the interests of the organization.
- Evaluate employment practices for legal risk, establish priorities for process improvements, and advise on appropriate solutions for compliance issues and employment disputes.
- Provide guidance, direction and counsel to management and employees on various matters including, but not limited to, Fair Labor Standards Act, prevailing wage regulations, M/W/DBE, Small Business, Section 3, OFCCP, Americans with Disabilities Act, Fair Pay and Safe Workplaces Act, and Foreign Corrupt Practices Act
- Develop and conduct corporate training regarding compliance, labor and employment practices and developments in related laws and regulations.
- Direct, advise, and conduct internal investigations, as necessary, including sensitive investigations.
- Response to prelitigation demand letters.
- Assist with and direct management of corporate ethics and compliance program including day to day operation, implementation of new initiatives, monitoring and revision of the program.
- Support overall compliance efforts for the organization.
- Perform other job functions as are necessary and may be assigned to support the legal needs of the company.
- Juris Doctorate from an accredited law school
- 4-7 years of practical relevant labor and employment experience with previous inhouse experience preferred
- Previous compliance experience preferred
- Admission to a state bar
- Highly developed written and oral communication skills
- Ability to assess potential risks, benefits and consequences of decisions, balancing legal and practical business considerations
- Travel as necessary to attend meetings, conduct trainings, audits and investigations
- Required to work in-person at our West Loop Headquarters
