The Hearing Officer shall preside over all adjudicators hearings and shall have the following powers and duties: hear testimony and accepting evidence that is relevant to the existence of the Code violation; issuing subpoena directing witnesses to appear and give relevant testimony at the hearing upon the request of the parties or their representative; preserving and authenticating the record of the hearing and all exhibits and evidence introduced at the hearing; issuing and signing a written finding, decision and order stating whether a Code violation exists; imposing penalties consistent with applicable Code provisions and assessing costs upon finding a party liable for the charged violations, except, however that in no event shall the Hearing Officer have authority to impose a penalty of incarceration; issue subpoenas as authorized by the Coles County Nuisances Ordinance and as hereafter set forth in the Ordinance; holding settlement conferences; administering oaths and affirmations; ruling upon motions, objections, and the admissibility of evidence; compelling the production of relevant documents, record or other information; and exercising all powers and duties necessary and proper to the administration of fair hearings.
Qualifications: Individuals who have worked with private industry or government in environment, regulatory, quality assurances, education administration, or legal administration. Applicant must be willing to become knowledgeable of ordinances to be enforced and complete a formal training program. A Hearing Officer may not be a Code enforcement officer or a law enforcement officer.
Time may require 2 to 3 days per month.
