Summary:

The Deputy Chief, Capital Compliance, Contracts & Risk is responsible for the establishment of standards and procedures and ensures that the Capital Programs Department effectively and efficiently complies with applicable federal and state rules, standards, and guidance. The Deputy Chief is also responsible for overseeing the negotiating of complex contracts and third-party agreements to support project delivery and directs NJ TRANSIT’s pass-through transit grant programs for community-based transportation operations.

Roles and Responsibilities:

  • Oversees Capital Compliance with federal, state, and other regulatory frameworks including but not limited to, NJ TRANSIT’s and Capital Programs’ own policies and procedures, corporate-wide policies.
  • Responsible for formulating and developing policies and procedures to assure the proper implementation of NJ TRANSIT’s Federal Transit Administration-approved management plans, including monitoring progress towards goals and objectives.
  • Establishes standards and implements procedures to ensure that Capital Programs internal controls are effective and efficient in identifying, preventing, detecting, and correcting compliance gaps, if found, in connection with applicable federal and state rules, standards, and guidance.
  • Directs staff responsible for interfacing with internal and external entities, such as auditors and oversight monitors and oversees the uniform, timely, and responsive handling of requests for information and review of findings and other reports.
  • Ensures coordination of compliance activities to remain abreast of the status of all compliance activities and to identify trends and oversees the effective coordination and development of risk registers, mitigation plans, and change controls.
  • Directs and ensures the proper monitoring of NJ TRANSIT’s pass-through transit grant programs, including operating budgets and publishing of annual financial report.
  • Directs policy formulation on major projects/policies/issues related to community transportation that take into consideration NJ TRANSIT policies, State or FTA rules and regulations and external concerns.
  • Provides liaison with but not limited to legal entities, agencies, authorities, Amtrak and freight railroads with and/or on behalf of the SVP, Capital Programs.
  • Manages the development of strategies and oversees the negotiation of agreements and frameworks with third-parties (i.e. utilities, public entities, public agencies/authorities, and railroads) for complex transactions required to implement Capital projects, the settlement of claims and mediation of claims.
  • Provides senior management recommendations for resolution of or actions to be taken regarding active claims.
  • Directs the production of analytical pieces, policy briefs and other program- or project-level reports for senior executives or third parties, as required.
  • Engages with senior executives throughout NJ TRANSIT, other government instrumentalities and organizations both public and private to support programmatic goals, policies and procedures.
  • Leads effort to improve efficiency and to reduce vulnerability to fraud, waste, and abuse.
  • Other tasks as assigned by the Chief, Capital Compliance, Budget and Administration.
  • This position supervises: Senior Director-Contracts & Claims; Senior Director-Compliance & Risk Officer; Senior Program Director-Research & Community Service

Education, Experience, and Qualifications:

  • Bachelor’s Degree in Public Administration, Business Administration, Auditing, Pre-Law or related field and ten (10) years of progressively responsible experience in compliance matters, dispute resolution, and familiarity with administrative law and procedures required.
  • Juris Doctorate from an ABA accredited law school, CPA, or related advanced degree desired.
  • Working knowledge of Microsoft Office software is required.
  • Skilled in managing multiple priorities and making timely decisions.
  • Strong oral presentation and written skills required.
  • Experience managing independent reviews, oversight, or litigation desired.
