Job Summary:
This position is accountable for the delivery of litigation-related services required by the Company as requested and directed by the Senior Counsel, Litigation.
The position will provide legal services in the following areas: Legal Advice and Counsel, Claims Negotiation, Litigation and Defense, Contracts and Lease Approval, and other Legal Services.
Requirements:
Education:
  • Bachelor's degree required.
  • Law Degree from a fully-accredited American university required.

Licensing/Certification:
Must be currently admitted and in good standing to practice before the state and federal courts of Arkansas.
Experience:
  • Minimum five (5) continuous years' of full-time, active legal practice and experience, including primary focus on litigation background and experience required.
  • Knowledge of rules of civil procedure, rules of evidence and practice and procedural aspects of state and federal courts required.
  • Possesses background and knowledge of the Insurance Code, Insurance Department Regulations, federal ERISA standards and regulations, and case law relevant to health insurance industry preferred.
  • Knowledge of statutes, regulations, and significant case law in areas of general corporate law, labor and employment relations, bankruptcy, copyright, trademark, patent, antitrust, and other areas of concern to the Company preferred.

Essential Skills & Abilities
  • Microsoft Office (Word) proficiency to the extent of being able to perform most data processing, drafting and document production activities on a self-generated basis (with administrative assistance for exceptional volume demands).
  • Demonstrated ability to work cooperatively with a wide range of internal and external customers and contacts required.
  • Demonstrated ability to characterize a legal problem and predict probable implications and end results.

This is an onsite role, based in our Little Rock, Arkansas location.

Responsibilities:
Claims Negotiation: Negotiates claim settlements, where indicated, with members and their attorneys, either prior to or subsequent to litigation, as requested by Senior Counsel., Contracts and Lease Approval: Reviews and approves, as requested by management, all contracts, leases, proposals, and other legal documents which commit the Company or its affiliates or subsidiaries in any manner., Legal Advice and Counsel: Provides legal advice and counsel to all divisions, including affiliate or subsidiary corporations, as requested by Senior Counsel., Litigation and Defense: Defends all policyholders and member lawsuits against the Company. Defends or assists outside counsel in the preparation and defense of other lawsuits, as requested by Senior Counsel., Other Legal Services: Provides legal expertise in regard to subpoenas, bankruptcy matters, class action claims activities, fraud and abuse analysis and assistance, document and discovery management, research of legal issues, drafting of contracts, policies and procedures, forms or other legal documents, privacy and security matters, antitrust review and advice, Code of Business Conduct and annual conflict of interest review, compliance and risk reduction analysis and strategy development, and general litigation support services., Supervises and trains support personnel as needed.
