Job Title: Compliance OfficerDepartment: Administration

Reports to: Chief Executive Officer Effective Date: March 15, 2024

Hours of Work: 40 hours per week FLSA Classification: Exempt

Job Summary

Provides direction and oversight of the Company's compliance program. Identifies and assesses areas of risk, communicates the importance of the program to executive management and the board of directors, prepares and distributes the written code of conduct setting forth the ethical principles and policies which are the basis of the compliance program, develops and implements education programs addressing compliance and the code of conduct, implements a retaliation-free internal reporting process, and collaborates with executive management to effectively incorporate the compliance program within system operations and programs to carry out the responsibilities of the position.

Essential Functions

  • Create and implement an effective, legal compliance program that mitigates Company risk. Ensure that the implemented compliance program prevents and detects violations of law, regulations, organizational policies, and the code of conduct.
  • Review and update Company internal controls and compliance program, ensuring sound controls, solid documentation, and adherence monitoring are in place.
  • Complete risk analysis to discover areas of potential compliance risk and vulnerability. Create and implement solutions and corrective action plans to eliminate any potential risks.
  • Create and revise Compliance policies. Maintain master copies that conform to standards of accreditation and reimbursement agencies for behavioral healthcare. Ensure current versions are available to staff and archive outdated versions. Provide input as requested into other departmental policies.
  • Proactively audit processes, practices, and documents to identify weaknesses.
  • Evaluate Company liability and malpractice insurance policies for coverage levels, deductibles, etc. and make recommendations for needed changes, if any. Ensure such policies remain current and in-force.
  • Serve as primary point of contact and survey coordinator for The Joint Commission, State, and other external auditors (e.g., Arkansas Medicaid, Arkansas Division of Behavioral Health Services, etc.). Respond to and maintain agency correspondence such as application updates, complaints, etc. Ensure regulatory standards are made available to all employees.
  • Responsible for quarterly performance improvement reports and following up on any needed corrections.
  • Create written procedures to manage a crisis or compliance violation.
  • Assist in bid preparations, including performing reviews of quotes and submissions.
  • Remain informed of current legislation and enforcement issues affecting the healthcare industry, as well as compliance best practices.
  • Prepare reports for executive management on incidents, investigations, and all compliance issues.
  • Conduct due diligence on new businesses before they are acquired or begun and design an effective integration plan.
  • Train individuals regarding compliance, code of conduct, regulations, and industry practices.
  • Address employee concerns and questions regarding compliance.
  • Implement and operate retaliation-free reporting channels, including anonymous reporting systems available to all employees, volunteers, customers, and vendors.
  • Provide information to the Director of People Operations regarding investigations and other issues generated that may warrant development of corrective action plans.
  • Track all issues referred to the compliance office daily and document any corrective action plans put into place.
  • Develop productive working relationships with all levels of management.
  • Present periodic and annual reports on the compliance program to the board of directors.
  • Serve as liaison and primary contact to the board of directors.
  • Co-chair the Quality Assurance Committee and develop monitoring performance indicators procedures.

Required Skills / Abilities

  • Excellent communication and collaboration skills; ability to work with everyone at all levels of the organization.
  • Attention to detail and ability to work with complex and competing information.
  • Ability to collaborate and advise management on compliance matters; ability to develop practical business solutions and to facilitate risk assessment.
  • Ability to prioritize and manage multiple projects simultaneously.
  • Ability to travel to the office daily, or as required by the supervisor.
  • Proficient in Microsoft Office Suite or other similar software.

Education and Experience

  • Bachelor's degree in healthcare, nursing, healthcare administration, business administration, law, or related field.
  • Five or more years of healthcare compliance, management, or operations experience required.
  • Knowledge of healthcare legislation and how to research legislation changes.
  • Clear understanding of the financial aspects of the healthcare industry.
  • Related certifications in healthcare compliance preferred.
  • Knowledge of The Joint Commission Standards.

Physical Requirements

The physical demands described here are representative of those that must be met by an employee to successfully perform the essential functions of this job. Must have the ability to use a computer as required. Must be able to communicate with others in an understandable manner. Must be able to operate standard office equipment. Work is primarily sedentary but must be able to move through the building to access office equipment. May need to occasionally move light equipment. Regular attendance at work is a requirement of this position. Able to travel within the five-county catchment area and to conferences/training as required.
