The United Mine Workers of America Health and Retirement Funds (the Funds) has an immediate opening for an in-house attorney with experience in some or all of the following areas: qualified employer pension plans, employer health & welfare plans, labor and employment, litigation. The Funds is a group of six multiemployer plans that provide pension and health benefits primarily to retired union coal miners and their eligible dependents.
The attorney’s principal responsibilities will involve providing legal advice to the Funds’ Trustees and staff regarding all aspects of administering an employee benefit plan. Duties include, but are not limited to:
· provides legal advice regarding ERISA compliance, benefits eligibility, tax, and contracts;
· represents the organization in litigation involving benefits eligibility and delinquent employer contributions and bankruptcy proceedings;
· advises the Funds on matters that relate to HIPAA, Medicare compliance, and various laws applicable to health plans;
· researches legal issues, drafts legal memoranda, drafts, reviews and interprets legal documents; and
· monitors and ensures compliance with applicable statutes and regulations, applies and interprets statutes and regulations and recommends appropriate action.
Candidates should possess superior analytical and writing skills, be self-motivated and detail-oriented. Preferred candidates will have knowledge of ERISA and Internal Revenue Code, plus up to 3-10 years of related experience and/or training. Candidates must possess a law degree (J.D.) and bar admission.
