Overview:
A Construction Company is a fourth-generation heavy and industrial infrastructure builder, based in Nebraska. A Construction Company seeks an Associate Counsel to join our Risk and Compliance Team. This role involves a diverse range of responsibilities including key contract negotiation, litigation management, and executive legal consulting. The successful candidate will work closely with our project leadership, executive team, and various back-office groups, providing expert legal advice and support. Reporting directly to the Corporate Counsel, the Associate Counsel will play a key role in navigating legal issues that arise on Nebraska's most complex and critical infrastructure projects.
Key Responsibilities:
Construction Legal Review

• Review and analyze subcontracts to ensure legal compliance and protect company interests.
• Provide advice and issue spotting to project leadership, ensuring smooth legal operations.
• Review project bid documents for legal accuracy and completeness.
• Resolve legal issues that arise on jobsites, balancing legal risks and business objectives.
• Negotiate contracts and terms with suppliers, maintaining favorable conditions for the company.
• Consult job sponsors on legal aspects of project work, ensuring informed decision-making.
• Investigate jobsite issues such as utility hits and construction damage and respond accordingly.

Litigation Management

• Select and direct outside counsel to represent the company's interests in legal matters.
• Attend court hearings and provide essential guidance on legal strategies.
• Lead dispute negotiations, aiming for resolutions that favor the company.
• Coordinate internal discovery efforts, ensuring thorough and efficient legal proceedings.
• Respond to administrative actions, maintaining the company's legal standing and reputation.
• Coordinate claims with insurance professionals.

Legal Consulting

• Support the Risk and Compliance Team, advising on legal aspects of environmental, safety, health, and loss control.
• Provide ongoing legal advice to the executive team, aiding in strategic decision-making.
• Review and interpret emerging trends and laws impacting our business.
• Develop and implement strategies to respond to legal and regulatory changes.
• Ensure internal policies are up-to-date and compliant with current laws.
• Advise other back-office teams on legal issues, promoting a culture of legal awareness.
• Develop and lead presentations to various Company groups on relevant issues.

Position Requirements:
Requirements:

• Juris Doctor (JD) degree from an accredited law school.
• Law license in good standing with the Nebraska Supreme Court Attorney Services Division, or other state equivalent.
• Admitted (or ability to be admitted) to all state and federal courts in Nebraska.
• Ability to travel nationally up to 10 days per year.
• Ability to visit urban and rural jobsites up to several times per week.
• A valid Nebraska motor vehicle operator's license.
• Physical ability to traverse rugged construction projects, including uneven ground, climbing, hot and cold conditions, all for extended periods of time. Must be able to lift at least 25lbs, stand and sit for extended periods of time.
