POSTING OBJECTIVE
BENTON COUNTY IS CURRENTLY ACCEPTING APPLICATIONS TO FILL A TEMPORARY PART-TIME ASSISTANT COUNTY ATTORNEY I POSITION WITHIN THE COUNTY ATTORNEY'S OFFICE.
PLEASE NOTE: THE EMPLOYMENT PERIOD FOR THIS POSITION WILL BE NO LONGER THAN 6 MONTHS FROM THE "EMPLOYEE START DATE" AS THIS IS A TEMPORARY PART-TIME POSITION, WITH A MAXIMUM OF 29 HOURS PER WEEK.

Assistant County Attorney I (Grade 14): The hiring wage range for this position will be $37.67 - $40.46 per hour, depending on preferred qualification experience.

Position Summary
Performs professional legal work assisting the County Attorney in performing duties as legal counsel and criminal prosecutor for Benton County.
Essential Duties and Responsibilities
Duties and Responsibilities
Essential Functions - As a Temporary PT Assistant County Attorney IA. Represents Benton County and the State by prosecuting petty misdemeanors, misdemeanors, and gross misdemeanors, including contested evidentiary hearings, court trials, jury trials, bail hearings, omnibus hearings, sentencing hearings, and probation revocations.
B. Performs file review, including review of criminal histories, sentencing guidelines, legal research, rules of criminal procedure, case law and Minnesota statutes.
C. Communicates and coordinates with witnesses, victims, pro se defendants, and other attorneys.
D. Makes all criminal court appearances, including Rule 5, Rule 8, bail hearings, pretrial, contested omnibus, settlement conference, trail, sentencing, restitution, probation violation, review hearings, and post-conviction relief hearings.
E. Completes legal research and interprets laws and statutes.
F. Writes legal motions and briefs to submit to the Court.
G. Prepares documents including appeals to the Minnesota Court of Appeals and Minnesota Supreme Court.
H. Reviews and analyzes criminal cases with police reports, video, and other evidence.
Additional FunctionsA. Performs other duties as assigned.
Minimum Qualifications - Training and Experience Required
Qualifications
Minimum QualificationsA. Juris Doctorate from an accredited law school; and
B. Must be licensed to practice law in the State of Minnesota; and
C. One-year relevant work experience.
Conditions of Employment
A. Must possess a valid driver's license and be able to drive in the state of Minnesota.
B. Must successfully complete a background check.
C. Obtain and maintain certifications and licensures.
D. Ability to travel in with your daily work assignment.
E. Ability to travel within Minnesota, including overnight stays.
F. Ability to work extended, evening and weekend hours as needed.
G. Must comply with organizational and departmental policies.
H. Performs physical/mental demands of the work environment requirements for this position.
I. Attendance during regularly scheduled work hours, and outside regular hours as necessary.
J. Effective and respectful communication and interactions with other employees, supervisors, individuals from other organizations, and citizen customers.
K. Must comply with data practices policies and standards relative to private data. Any access to private data should be strictly limited to accessing the data that are necessary to fulfill the employment responsibility. While data is being accessed, employee should take reasonable measures to ensure the private data is not accessed by individuals without a work reason. Once the work reason to access the data is reasonably finished the private data must be properly stored according to county policies and the Minnesota Statutes.
Minimum Knowledge, Skills, Abilities, Physical Demands and Working Conditions Required
Knowledge, Skills, and Abilities: - As a Temporary PT Assistant County Attorney IA. Knowledge of Federal, State and Local criminal and civil law.
B. Knowledge of rules of evidence and skill in analyzing evidence.
C. Knowledge of court rules including civil procedure, criminal procedures, and appellate procedure.
D. Skill in prosecuting criminal cases.
E. Skill in evaluating, preparing, and managing cases.
F. Skill in performing legal research.
G. Significant skill in presenting written and oral arguments.
H. Ability to work with law enforcement and human services personnel.
I. Ability to work under limited supervision with general autonomy in determining how objectives are achieved; supervisors generally set operating benchmarks, goals, and objectives.
Physical Demands & Working ConditionsA. Light physical effort in sedentary to light work, but which may involve some lifting, carrying, pushing and/or pulling of objects and materials up to 20 pounds.
B. Work is performed in an office or court setting. Headaches, eyestrain, and other related occupational hazards reflect the most common potential for injury.
C. Some exposure to verbal abuse from hostile, angry or frustrated persons.
D. This position frequently performs work under high attention to detail and deadlines.
Hours of Work - As a Temporary PT Assistant County Attorney IA. Monday - Friday 8 a.m. - 4:30 p.m., ALTHOUGH LIMITED TO NO MORE THAN 29 HRS./WEEK.Equipment UtilizedA.
