Description
The Education and Labor Cabinet’s mission is to educate, prepare and train Kentucky's current and future workforces. The Education and Labor Cabinet is seeking to fill a Workers’ Compensation Coverage & Compliance Investigator III position located within the Department of Workers’ Claims, Division of Security & Compliance Branch, Enforcement Section. This position works within a six (6) county area, including, Clark, Estill, Southern Fayette, Madison, Montgomery and Powell counties.
Responsibilities include, but are not limited to, the following:
  • Independently conducts complex, in-depth investigations of employers to verify compliance with the Worker's Compensation Act (KRS Chapter 342). Conducts investigations of construction sites to ensure contract worker compliance and verifies businesses have required worker protection coverage.
  • Files report of non-compliance when requirements are not met. Advises company headquarters of issues and concerns and notifies them that the case is being referred for prosecution.
  • Investigate complaints and injury claims filed against Uninsured Employer's Fund to determine if coverage does exist. Write comprehensive investigative reports and transmit these reports (investigative and administrative) electronically within pre-defined guidelines and time limitations.
  • Contact insurance carriers, insurance agents and other resources, interpret and enforce multi state coverage endorsements required for compliance. Identify compliant and non-compliant employers and counsel employers regarding requirements to be compliant.
  • Trains and serves as mentor to staff investigators. Interprets workers' compensation insurance coverage and compliance requirements to insurance agents, underwriters, attorneys, and others to ensure an understanding of compensation compliance issues. Independently conduct or participate in presentations, training seminars, or public forums and programs.
  • Testify in citation hearings and other official proceedings as necessary.
  • Performs other duties as assigned.
Preferred Knowledge/Skills/Abilities:
  • Demonstrate the ability to communicate clearly and concisely
  • Work cooperatively with a team
  • Have a working knowledge of Microsoft Office products and a history of working with databases and reports.

Minimum Requirements
EDUCATION: Graduate of a college or university with a bachelor's degree.

EXPERIENCE, TRAINING, OR SKILLS: Four years of experience in investigations, insurance claims adjusting, insurance underwriting, or in the fields of risk management employment or property and casualty insurance.

Substitute EDUCATION for EXPERIENCE: Additional related training will substitute for the experience on a year-for-year basis.

Substitute EXPERIENCE for EDUCATION: Additional experience in one of the above or related fields will substitute for the education on a year-for- year basis.

SPECIAL REQUIREMENTS (AGE, LICENSURE, REGULATION, ETC.): Must possess a valid driver's license at time of appointment in this classification. Must maintain any required licensure(s), certification(s), or other credentials for the length of employment in this classification. Employing agency is responsible for ensuring employee possesses and maintains required licensure(s), certification(s) or other credentials.
Working Conditions
Travel will be required to check employers for Workers' Compensation insurance coverage and to investigate claims.
Probationary Period
This job has an initial and promotional probationary period of 6 months, except as provided in KRS 18A.111.
