THE OPPORTUNITY

Together with the Managing Counsel/VP responsible for trademark matters, the Trademark & Copyright Paralegal will play a meaningful role in building and protecting Scholastic's brands. The Trademark & Copyright Paralegal will also work with the Deputy General Counsel/VP on certain copyright matters, primarily enforcement of Scholastic's copyrights. In addition to the above IP-centric duties, the Trademark & Copyright Paralegal may, as time allows, be required to help with certain tasks/duties related to non-trademark and/or non-copyright claims/litigations.

RESPONSIBILITIES

Core responsibilities:
  • Conduct and analyze trademark searches to help determine availability of trademarks, taglines, product names, and other consumer-facing content;
  • Handle the day-to-day prosecution of domestic trademark applications and USPTO responses, with outside counsel help where necessary, including corresponding with other Scholastic employees to obtain evidence of use and other information needed for clearance, prosecution, and enforcement;
  • Work with outside counsel on the prosecution of foreign trademark applications;
  • Provide guidance to Scholastic employees regarding proper use of trademarks and trademark notices;
  • Review advertising, point-of-sale and promotional materials for proper use of Scholastic's trademarks;
  • Conduct trademark portfolio reviews;
  • Provide support on trademark and copyright infringement and other enforcement actions, including conducting research, collecting evidence, and preparing draft letters and takedown notices;
  • Assist in managing trademark opposition and cancellation actions, including review of Watch Notices and gathering of evidence; and
  • Actively participate in trademark and copyright-related special projects when necessary.

Qualifications

HOW YOU CAN FIT (Qualifications)

Generally speaking, successful candidates will need to be able to take initiative, think independently, exhibit a sense of urgency and a "what else can I do" attitude, and perform sophisticated tasks of a highly sensitive nature which affect Scholastic's valuable brands and properties. Candidates must also possess the following:

  • Bachelor's degree and/or paralegal certificate.
  • 5-7 years of experience as a trademark paralegal (strong preference for prior in-house experience) with responsibilities on a global trademark portfolio.
  • Ability to consistently plan, organize, work independently, think critically, meet deadlines and remain flexible in a multi-task environment.
  • Adept at conducting online trademark searches.
  • Ability to draft trademark and copyright cease and desist letters and manage the enforcement process.
  • General knowledge of domestic and foreign trademark law, policies and processes.
  • Work well in a team environment and value collaboration and communication across the team.
  • Friendly, approachable style that fits with Scholastic's culture.
