Overview

Lantheus is searching for a Senior IP Counsel. This is an exciting opportunity to join the highly collaborative, experienced legal team of an established Nasdaq-listed radiopharmaceutical-focused company. Reporting to the Vice President, Deputy General Counsel-IP, the successful candidate will be an experienced IP attorney in the pharmaceuticals sector who will be instrumental in supporting the Company’s long-term growth strategy and core mission to find, fight and follow serious diseases.

Our executive offices are located in Bedford, Massachusetts, with additional offices and manufacturing facilities in North Billerica, Massachusetts; Montreal, Canada; and Lund, Sweden.

Position Information:

Spend a few minutes reading about our Company’s transformation as a leader in the renaissance of radiopharmaceuticals with the successful launch of our prostate cancer diagnostic and our future in precision medicine through the most recent additions to our clinical development pipeline, and that will give you a sense of who the Lantheus team is and where we are going.

The Lantheus legal team is experienced, well-regarded, and close-knit, and is committed to integrity, high quality work product, pragmatic advice, professional development, and career advancement. The successful candidate will find the work in the Legal Department to be sophisticated, diverse, and challenging, with consideration of cutting-edge IP strategies and issues directly impacting the growth and success of the company’s business.

This attorney will advise on a wide range of IP matters including patent prosecution, overall IP strategy, patentability, and freedom-to-operate and will be responsible for budgeting and cost management worldwide for the patent and trademark portfolio they oversee. The successful candidate will be a part of multidisciplinary project teams and engage with colleagues at all levels of the organization to understand all aspects of the business to enable them to implement an effective IP strategy, proactively solicit invention disclosures, and educate colleagues on Lantheus’ IP strategy, while actively participating in agreement negotiations and other transactional work.

Among their other duties, the successful candidate will:

  • Strategically manage an Intellectual Property portfolio for both in-licensed and owned IP to maximize the value and utility of Lantheus’ assets worldwide.
  • Conduct, direct and analyze patent searches and render opinions on validity, non-infringement, and patent avoidance of third-party patents.
  • Work closely with Research & Development, Clinical Development, Pharma Services, Business Development, Technical Operations and Commercial teams to proactively identify and assess invention disclosures, strategic IP acquisitions, and life cycle management opportunities.
  • Effectively manage outside counsel and corresponding budget for worldwide prosecution of patent and trademark applications, patentability, and freedom to operate assessments and other legal opinions and risk assessments.
  • Contribute to and maintain positive relationships with strategic external relationship counterparts.
  • Support IP disputes, litigation, IPRs, PGRs and oppositions, including collaborating with the Vice President, Deputy General Counsel-IP and outside litigation counsel to formulate appropriate IP litigation strategies.
  • Provide high level, independent support for due diligence, mergers and acquisitions, strategic collaborations, licensing agreements and other business contracting needs with an IP focus.
  • Develop a thorough understanding of Lantheus’ current and planned business activities, programs, competitors, and markets and keep abreast of developing legal trends, laws, and regulations.
  • Educate and advise senior management & research teams on important IP issues and advance IP/patent awareness.
  • Review proposed research papers, publications, presentations, press releases and other materials for any impact on patent rights.
  • Provide timely, well-informed, “practical risk”-based advice and problem-solving skills to facilitate business decision-making in alignment with strategic objectives.

Qualifications

  • Qualified U.S. attorney (JD) and a member in good standing of at least one state bar and registered US Patent Attorney in good standing with US Patent Bar.
  • D., MS, or undergraduate degree in a relevant biological/biochemical science (small molecule/medicinal chemist highly preferred) is required.
  • At least 10 years of relevant IP experience in the pharmaceutical industry, including significant firm and in-house experience.
  • Exceptionally strong communicator (both verbal and written), supportive interpersonal team player, talented at collaborating cross- functionally to communicate complex information to all levels within an organization and contribute positively to Lantheus’ culture.
  • Must be comfortable participating in all aspects of Intellectual Property law including preparation and prosecution of patent applications and all aspects of IP portfolio management to meet budget.
  • Motivated self-starter who is able to manage multiple complex projects independently.
  • Practical problem solver with ability to recommend strategy, make data-informed decisions, make difficult decisions independently and confidently, and demonstrated capabilities in establishing business practices to manage legal and other risks.

Preferred requirements

Advanced degree in a relevant biological/biochemistry/medicinal small molecule chemistry science is preferred. Direct experience in biologic and chemical composition patents and managing products through development, marketing approval and post-approval preferred.

This position is intended to be hybrid, with an expectation of working out of the Company’s Bedford, Massachusetts executive offices three days per week (typically Tuesday, Wednesday and Thursday) and as otherwise necessary.

Compensation: Competitive base salary, bonus and incentive equity commensurate with experience.
