Reporting to the Senior Managing Counsel - North America, the Senior Counsel – NA Products and Litigation position provides counsel to internal clients on legal matters within recognized area(s) of expertise and responsibility, to preserve and protect the rights and interests of the company; and manages outside counsel in claims and litigation (products liability, product performance, toxic tort, and other disputes) as they arise.
This position is HYBRID (Racine, WI or Chicagoland area) with flexible work arrangements.
Responsibilities:
- Litigation/Dispute Resolution (75%):
- Directly manage a significant portion of A Capital Goods Company's US and Canadian litigation docket and material pre-suit claims.
- Direct and advise outside counsel during all phases of claims and litigation to protect A Capital Goods Company business interests; develop and guide discovery, trial and/or settlement strategy in conjunction with A Capital Goods Company objectives.
- Manage outside counsel, experts/consultants, staffing, fees and case budgets; set and monitor appropriate reserves.
- Interface with A Capital Goods Company Risk Management and insurers in reporting and coordination of claims for insured matters.
- Litigation portfolio includes: high-level, complex products liability and commercial claims (80%) and toxic tort (20%). Commercial claims may include, among other things, dealership and affirmative recovery matters.
- Counseling (25%)
- Counsel product platforms and other internal stakeholders regarding product compliance, warnings, and best practices with implementation of post-sale remedies.
- Counsel internal clients on resolution of customer, supplier and commercial disputes.
- Facilitate training and support and development of processes and procedures to anticipate, avoid and mitigate disputes.
Qualifications:
The qualified candidate will have:
- J.D. Degree and a current member of the appropriate State Bar or ability to register as in-house counsel.
- Minimum 7 years of related legal experience with significant experience directly advising in-house business clients and independently managing all aspects of litigation with outside counsel.
- Ability to travel domestically to Company facilities and other offices, as well as various legal venues, as required periodically.
The preferred candidate will have:
- Strong foundation of experience in areas of the law applicable to Company operations. Focus, experience and emphasis in product liability and toxic tort litigation is essential.
- Experience working for a manufacturing company or a manufacturing client.
- Judgment, independent thinking and clear strategic analysis in a fast-paced environment.
- Ability to provide timely, practical legal advice and answers to internal clients within a business context.
- Skills and awareness for communication and interaction across cultures with colleagues in other regions.
- Team player yet self-sufficient, focused on providing practical business solutions.
- Willingness to respond to clients and counsel beyond regular business hours when needed.
