NY HELPS Non-Competitive Minimum Qualifications:
Position may be filled at the Senior Attorney level or one of the Assistant Attorney traineeship appointment levels. Appointment title will be dependent upon qualifications of candidate selected.
Assistant Attorney 1 (Grade 18): Law school graduation and/or eligibility for NYS Bar Admission.
Assistant Attorney 2 (Grade 20): Admission to NYS Bar
Assistant Attorney 3 (Grade 22): 12 months as an Assistant Attorney 2, or Admission to the NYS Bar and 12 months of subsequent satisfactory legal experience
Senior Attorney (Grade 25): 12 months as an Assistant Attorney 3, or Admission to the NYS Bar and 24 months of subsequent satisfactory legal experience
NOTE: Admission to the New York State Bar and current registration to practice law in New York State is required for continued employment. Disbarment or loss of registration shall result in termination or suspension of employment.

Duties Description
The attorney will provide legal support to the Division of Child Care Services (DCCS) regarding a broad spectrum of issues related to the child care assistance program and child care programs throughout the state. Additionally, the Senior Attorney will be responsible for supporting the DCCS on contract, fiscal, supervision and compliance work. In addition, the Senior Attorney will assist the attorney general in defense of the agency in any associated litigation including minor litigation such as Article 78 challenges and major litigation such as federal class actions. The candidate will:
- provide legal support in development and review of state legislation, regulations and policies.
- review and support implementation of federal legislation and regulations.
- prepare legal opinions on policy initiatives.
- respond to and support the agency in external audits and stakeholder inquires.
- provide legal support regarding federal funding and fiscal issues related to the functions of the agency.
- conduct legal research and develop legal opinions as assigned.
- review draft requests for proposals, contracts, grant applications, reports and rate setting documents.
- review and assist in providing training to OCFS attorneys and agency staff on related legal topics.
- Additional legal responsibilities may include appearance at administrative hearings or in court regarding subpoenas or orders for submission of records.
