The Division of Professions and Occupations (DPO) provides consumer protection through its regulation of more than 500,000 licensees within more than 50 professions, occupations, and businesses in the State of Colorado.
The DPO Director's Office is reflective of organizational changes made in an effort to ensure effectiveness, efficiency, and consistency in board and program processes and elegance in the contributions of the DPO to the regulatory environment in Colorado.
Position: SJA 9820
The Natural Medicine Health Act of 2022, a citizen-initiated measure related to the use of certain plans or fungi for people 21 years of age and older, was approved by Colorado voters in November of 2022. In May 2023, Colorado Governor Jared Polis signed SB23-290: Natural Medicine Regulation and Legalization into law, which clarifies and sets the regulatory
framework for a regulated natural medicine program in Colorado. The Division of Professions and Occupations is currently working with the Natural Medicine Advisory Board, Department of Revenue, Department of Public Health and Environment and stakeholders to implement these laws. The Division of Professions and Occupations will begin taking applications for natural medicine facilitators no later than December 31, 2024.
This position is responsible for analytical and legal policy support for the Regulatory Analyst regarding the implementation of SB23-290: Natural Medicine Regulation and Legalization, which includes providing legal support work through research, analysis and the proposal of legally defensible administrative rules and open records responses to promote the Division's mission to effectively regulate professions and occupations in the state. This position is responsible for researching regulatory trends and laws, analyzing such information and proposing program rules. The position develops, coordinates, and implements consistent and legally sound rulemaking processes and proposes solutions to the Regulatory Analyst to address issues identified through collaboration with the Office of Legislative Legal Services. This position directly supports the Regulatory Analyst to uphold the Division's strategic objectives to reduce regulatory burdens, ensure a competitive marketplace, early engagement of stakeholders in the rulemaking process, and legally sound open records responses.
In collaboration with the Department, other state and local agencies, and the Programs Unit, the position reviews, researches, and analyzes records and proposes legally sound responses to the hundreds of open records requests received by the Division and provides input on media responses, when needed. This position consistently applies the provisions of the Colorado Open Records Act and applicable case law.
This position supports the Regulatory Analyst to drive problem and risk identification, critical analysis, and the facilitation of effective modifications to current practices in order to ensure a legally defensible product. The position coordinates multiple short - and long-term projects with varying deadlines and urgency requiring prioritization and tactical planning for the appropriate resources. The position also coordinates the outreach and engagement of diverse groups of external stakeholders including applicants, licensees, employers, professional associations, and other state agencies through surveys, focus groups, and stakeholder meetings to leverage partnerships and ensure best practices and policies for the Natural Medicine Advisory Board and the Division's 50+ various professions and occupations.MINIMUM QUALIFICATIONS (MQs):
  • Graduation from an accredited college or university with a bachelor's degree in business administration, business management, law, political science, public administration, sociology, or a field of study related to the work assignment;
  • Two (2) years of professional* experience, which must include all of the following:
    • Conducting legal research, preparing drafts of legal documents and gathering and compiling data from legal references and resources;
    • Conducting data analysis: metric development and tracking; collecting, compiling, and organizing data; and determining effective reporting mechanisms.

SUBSTITUTIONS:
  • A combination of professional* policy analyst experience, which provided the same kind, amount, and level of knowledge acquired in the required education, will be substituted on a year-for-year basis for the bachelor's degree;
  • A master's or doctorate degree from an accredited college or university in business administration, business management, law, political science, public administration, sociology, or a field of study related to the work assignment will be substituted for two (2) years of the professional* work experience.

*Professional work involves exercising discretion, analytical skill, judgment and personal accountability and responsibility for creating, developing, integrating, applying, and sharing an organized body of knowledge that characteristically is: uniquely acquired through an intense education or training regimen at a recognized college or university; equivalent to the curriculum requirements for a bachelor's or higher degree with major study in or pertinent to the specialized field; and continuously studied to explore, extend, and use additional discoveries, interpretations, and application and to improve data, materials, equipment, applications and methods.

Preferred Qualifications/Competencies:
  • Demonstrated experience implementing new programs and processes;
  • Experience working in a regulatory environment, law firm, or in a government agency;
  • Experience and working knowledge of Colorado Open Records Act (CORA) and Freedom of Information Act (FOIA) requests;
  • Experience working with and knowledge of administrative rules, the rulemaking process, and the Administrative Procedure Act (APA);
  • Experience coordinating stakeholder outreach and engagement;
  • Demonstrated experience working in a high-stress, fast-paced, high-profile environment, and adapting to shifting priorities, as needed;
  • Demonstrated project management experience, including managing varied and multiple projects to completion.
  • Demonstrated knowledge of and experience working with Colorado statutes, laws, and regulations.
