Qualifications
Individuals hired as advocates must demonstrate an understanding of ‘expressed interest’ vs. ‘best interest’. An advocate in this position operates under the premise of providing services that represent the expressed interest of the client – be that either inpatient or reside in the community. Lived experience in the mental health system and openness about that experience are qualities that are desirable for employment.
Individuals accepted for employment will undergo in-depth training regarding rights and regulations afforded to individuals in the mental health system. They receive complete training and ongoing education regarding the civil commitment process and hearing representation. Newly hired advocates without experience are required to participate in mandatory online training provided by the California Office of Patients’ Rights.
Applicants must be able to read, write, and speak Spanish fluently.
Duties
The Title IX Advocate is expected to perform the following functions:
· Representation in Certification Review Hearings, W&I 5270 extended stay Hearings and Medication Capacity (Riese) Hearings. That representation requires confidential interviewing of the individual, chart reviews and general preparation for the Hearing Process as mandated in the W&I Code.
· Complaint Investigation and resolution
· Issue mediation between treatment or supervisory staff and clients
· Education of both clients and staff regarding patients’ rights and related regulations, including legal options available to them to challenge their involuntary hold.
Duties that a Title IX Advocate cannot provide:
· No referral to attorneys for representation or other legal services
· No Clinical or Therapeutic services to any clients in any setting
