Position Summary:

The Patent Counsel is a critical role which will provide direct support to the Senior Director, IP and the Vice President, Chief Patent Counsel and to a variety of business functions, including product development, business development, sales, marketing, finance, and administrative groups, as well as providing support as needed to other attorneys on a wide variety of matters. This attorney will work on a wide variety of Intellectual Property matters within the Intellectual Property Department at Globus including: Patent Filing & Prosecution, Product Clearance, and Due Diligence. In addition, this individual will help plan, develop and implement overall goals and strategy for the IP department at Globus to meet agreed performance plans. 

Essential Functions:

  • Responsible for filing and prosecution of Globus patent portfolio, domestic and foreign, to build significant intellectual property value from inventions. Also responsible for timely filing and approvals on trademarks and copyrights as required
  • Responsible for timely clearance/FTO opinions for product development personnel to ensure timely completion of projects. Working with engineers and managers in product development early on in the development process and providing advice to ensure that the design pathway is clear of existing competitive intellectual property
  • Assists management in IP due diligence activities for mergers and acquisitions, as requested
  • Works with business counterparts to identify and provide advice regarding legal risks and issues
  • Assists senior members of the legal department with other legal needs of the company as necessary and contribute to the overall legal function
  • Develops a thorough understanding of and familiarity with the Company's business, its people, products, technology, markets, facilities, customers and competitors in order to assist the company in meeting overall business objectives
  • Provides training and make presentations to company personnel regarding legal issues.
  • Supervises non-lawyer staff and manage outside counsel, as necessary
  • Adheres to the letter and spirit of the company Code of Conduct, the AdvaMed Code, MedTech Code, and all other company policies. Ensures Compliance with applicable governmental laws, rules, and regulations, both in the United States and internationally, by completing introductory and annual training and maintaining knowledge of compliance as it applies to your role
  • Represents the company in a professional manner and uphold the highest standards of ethical business practices and socially responsible conduct in all interactions with other employees, customers, suppliers, and other third parties

Qualifications:

  • J.D. with engineering undergraduate/graduate degree, preferably Biomedical, Mechanical or Electrical Engineering. Experience with medical devices is preferred
  • 3 to 10 years' experience in domestic and foreign patent filing and prosecution. Preferred experience also includes analyzing commercial products and drafting clearance/FTO opinions and in exposure to litigation and ancillary transactional areas with growing responsibilities preferably in the medical device field
  • Pragmatic judgment, particularly in determining the significance of legal matters and effectively measuring and balancing legal and business risks
  • Effective organizational skills in order to prioritize and manage multiple time-sensitive projects simultaneously
  • Strong, hands-on work ethic with willingness to assume heavy workload to meet timing and project needs
  • Excellent written and oral communication skills, with ability to synthesize complex legal issues to essential elements for clients throughout the organization with different abilities and responsibilities
  • Strong interpersonal skills, including optimism, diplomacy and flexibility, and the ability to interface effectively with personnel at many different levels throughout the Company
  • Ability to delegate and supervise
  • Ability to travel up to 10% of the time to spend time at various company locations to understand our business and provide guidance and training
  • Admission to practice law in at least one state and the Patent Bar

  • Required to regularly lift and/or move up to 10 pounds, and occasionally lift and/or move up to 25 pounds
