Job Summary
Under the direction of the Assistant Vice President of Human Resources, the Manager, HR Compliance and Investigations monitors the University's compliance with all aspects of affirmative action, EEO,Title VII Title IX, and related regulations, performing investigations with a significant degree of latitude and independent judgment in carrying out job responsibilities.
The Manager is responsible for providing support to leaders on coaching disciplinary matters, goal setting, and development plans.
The primary investigator of EEO, Title VII, Title IX, and misconduct matters, the Manager has the ability work with emotional individuals in a compassionate, professional, and courteous manner while diffusing and managing situations involving intense conflict. Maintains confidences and exercise sound judgment and discretion while embodying neutrality and objectivity. The Manager has the ability to maintain professional relationships while dealing with sensitive, complex, and emotional civil rights, legal and Human Resources and situations.
Qualifications
Minimum Qualifications:
  • Bachelor's degree in Human Resources Management, Business Administration, or a related field plus 3 years of experience conducting employment-related fact-finding investigations, grievance resolution and management in an HR discipline.
  • OR juris doctor degree from an accredited law school plus 2 years of experience conducting employment-related fact-finding investigations and 2 years of experience engaging in employee grievance resolution and management of an HR discipline.
  • Experience applying and interpreting federal and state equal opportunity, non-discrimination, and other laws and regulations important to higher education (e.g. Title IX, FERPA, Clery Act, Title VII, Rehabilitation Act, etc.).
  • Proficiency with the Microsoft Office Suite, with particular emphasis on Word, Excel, and PowerPoint .
  • Upon hire, candidate must have reliable transportation to all HPU worksites and other locations as required by the position.

Desired Qualifications:
  • Active or inactive member of the Hawaii State Bar Association or State Bar of another state or District of Columbia and experience practicing employment law, including the investigation and defense of discrimination and other employment claims, wage and hour law, and labor-management relations.
  • Master's degree in Human Resources, business administration or related field with 3 years of experience as an HR manager to high-touch clients.
  • Professional experience investigating and resolving civil rights complaints, including complaints against sexual violence or sexual misconduct.
  • Experience with affirmative action and other laws and regulations important to federal contractors.
  • Experience in higher education, particularly in student affairs, Title IX coordination, and affirmative action.

  • Strong organizational skills with the ability to handle multiple projects concurrently; and
  • Conflict resolution and/or mediation skills;
  • Report to work obligations to support the department and may require work during HPU's winter break, if necessary;
  • Able to work all shifts and extended hours;

Key Responsibilities
1. Investigation 45%
  • The primary investigator of EEO, Title VII, Title IX, and misconduct matters.
  • Performs intake on allegations of misconduct.
  • Determine if there is a potential violation to warrant an investigation.
  • Timely responds to and closes investigations.
  • Assists supervisors and employees with staff relations issues and answers policy and practice questions for area of responsibility. Advises appropriate University officials and management on the enhancement of the University climate for faculty, staff, and students.

2. Human Resources 30%
  • Partners with constituents to support all aspects of Human Resources strategy and management, including delivery of HR-initiated programs as well as identification and fulfillment of HR support opportunities related to each division's operational goals.
  • Deploys a variety of development and problem-solving activities on an individual, department, and inter-department level.
  • Provides support to management in matters related to performance management and training in employee relations.
  • Partners with the Benefits and Leaves Administrator to respond to unemployment claims, including preparing responses and attending contested hearings.
  • Creates, plans, and organizes annual university-wide Professional Development Conference.
  • Manages HPU's Performance Management program, including annual performance reviews, goal setting, including the cascading of system goals, and development plans.
  • Develop, implement, and monitor training programs.
  • Manages and develops content for Mana`o (Cornerstone LMS), HPU's learning and performance management system.
  • Manages learning calendar.
  • Manages leadership development, including providing in person trainings, e-content, and weekly tips.
  • Contributes to Human Resources Newsletter.
  • Supports the AVP of Human Resources with regard to learning initiatives and partners with the Manager, Recruitment to develop and manage new hire training as part of new employee orientation.

3. EEO/AA Officer & Deputy TitleIX Coordinator 25%
  • As EEO/AA Officer and Deputy Title IX Coordinator, ensures University compliance with all aspects of affirmative action, EEO, Title IX, and related regulations, including timely generation of appropriate data (from NEOGOV and HR Banner) and information necessary to prepare an annual affirmative action plan involving faculty, staff, veterans, and individuals with disabilities and EEO/Title IX policies and advising on issues pertaining to officer compensation. Appropriately monitors pay equity and potential adverse impact trends in hiring, promotions, and terminations, providing reports and disparate impact evaluations on a quarterly basis.
  • Provides guidance and institution-wide employee training on EEO, AA, and Title IX matters. Supports HR training efforts on FLSA, ADA, and other employment topics. Assists the Faculty Actions Office and HR Recruitment Team in developing strategies and plans for the recruitment and retention of diverse faculty and staff.
  • Assists with the identification of deficiencies in diversity, and supports the establishment of goals and objectives relative to equal opportunity mandates and the University's AAP.
  • Assists in the identification of diversity recruiting sources consistent with the University's utilization goals.
  • Advises search committees and hiring managers on utilization goals.
  • Assists with monitoring applicant pools to ensure broad gender and ethnic representation.
  • Drafts, updates, and oversees the University's Affirmative Action and employment related EEO policies.
  • Consistent with EEOC, Title IX , and other guidance, and collaborating with the Title IX Coordinator advises on potential exposure of risk associated with complaints that assert violations of Hawai'i Pacific University's policies, including anti-discrimination policies and related procedures. Authors fact-finding investigation reports after interviewing the complaining and responding parties, determining relevant witness and documentary evidence, and interviewing persons believed to have pertinent factual knowledge of the allegations. Communicates and coordinates with University departments and administrative personnel as appropriate in handling complaints and issues related thereto.
  • Consistent with EEO/AA requirements, maintains a database of investigation issues and resolutions, including the cataloguing of disciplinary actions. Uses data-driven findings to improve practices. Shall provide reports, analyze data, and make recommendations to effect improvements to practice or policy. Files annual reports with the Title IX Coordinator detailing the number, nature, and disposition of complaints of sexual harassment, including sexual assault. Uses findings to inform intervention that may be achieved through development and deployment of training.
  • Builds and launches proactive educational, outreach, and other action-oriented employee programs to support the University's commitment to non-discrimination and its AAP and to promote a welcoming, supportive and inclusive environment and community. Creates and implements annual EEO/AA training project plan, including budget and timeline. Provides live training on such topics as affirmative action responsibilities, discrimination/harassment prevention (for supervisors and nonsupervisors), Title IX sexual assault reporting procedures, accommodations and the interactive process, timekeeping, and non-discriminatory interview techniques.
  • Assists with the review of online EEO training content and relays updates/changes to content for accuracy and completeness of information and links. Oversees appropriate data entry of training certifications. Coordinates requests for proposals from online vendors as appropriate.
  • Partners with constituents to support all aspects of Compliance Learning and Development for staff and staff leaders. Actions compliance development strategy and management, including delivery of Compliance-initiated programs as well as identification and fulfillment of HR support opportunities related to each division's operational goals. Deploys a variety of development and problem-solving activities on an individual, department, and inter-department level. Provides support to management in matters related to performance management and employee relations.

4. Other duties as assigned5%
  • Completes special projects, assignments and Investigations as assigned.
