Summary: Highly skilled and experienced Claims and IP manager that will have in-house legal department experience; areas of focus in Invacare will be in both product liability and Intellectual Property. The Claims and IP manager will play a key role in administering the Intellectual Property creation and protection process to help maximize and safeguard the value of Invacare Holding Corporation’s product portfolio. They will also be involved in a wide variety of product related activities such as coordinating and managing product liability claims and other product related matters.
Essential Functions:
Product Liability responsibilities:
- Manage and organize product liability claims and related documentation.
- Assist in preparing responses to product liability claims and associated discovery requests.
- Attend/prepare for court dates, depositions, product inspections, mediations as needed.
- Coordinate MMSEA reporting for product liability settlements.
- Coordinate litigation holds with the IT and Legal Departments and document custodians.
IP responsibilities:
- Manage and maintain the company's IP portfolio of patents and trademarks on an international basis.
- Assist in-house counsel in the development and implementation of an Intellectual Property strategy that aligns with the company's business goals and product roadmaps.
- Collaborate with engineers and technical teams on the one hand and outside counsel on the other hand, to coordinate drafting and prosecution of patent applications.
- Work closely with product management, sales, and engineering teams to manage patent maintenance fees and trademark renewals.
- Assist in-house and outside counsel in the clearance of proposed trademarks and patents.
- Prepare responses to discovery requests in litigation cases and quarterly reports to lenders.
General responsibilities:
- Assist in-house counsel in ensuring compliance with relevant laws and regulations in Intellectual Property and product liability matters.
- Prepare reports and summaries on the status of Intellectual Property and product liability cases for internal stakeholders.
- Complete all required training applicable to assigned position.
- Exhibit positivity, flexibility, creativity, and a willingness to take on new responsibilities as requested or required.
Qualifications:
- Minimum ten 10 years of experience in an in-house legal department, preferably with experience in managing an Intellectual Property portfolio and/or property liability claims.
- Associate’s degree required; Bachelor’s degree preferred.
- Excellent organizational and communication skills.
- Motivated, self-starter with proven track record of reliable work in a team environment.
- Strong analytical and problem-solving abilities.
- Detail-oriented with a commitment to accuracy while working under strict time constraints.
- Ability to work collaboratively in a cross-functional team.
- Experience working with management of software systems and databases, such as Dennemeyer DIAMS iQ, Thomas Reuters/Serengeti Legal Tracker and other systems.
- Ability to manage multiple priorities in a rapid paced environment.
- Ability to challenge the status quo and to help develop and implement more efficient methods and processes.
- Ability to maintain confidentiality and handle sensitive information.

- Availability for occasional travel (10%), extended or week-end hours when required.
