NOTE: This position is eligible for a hybrid telework schedule, as there are some on-site responsibilities required. Telework can be approved for alternate worksites within Washington state (counties in Oregon or Idaho that share a border with Washington).
The Opportunity:
The Office of Administrative Hearings (OAH) is currently looking to fill our Information Governance Officer (WMS Band 1) position in our Headquarters division. Reporting to a Deputy Chief Administrative Law Judge, this position has responsibility for multiple programs at OAH, a small-cabinet executive agency: Public Records Officer; Public Information Officer; Litigation/Discovery Coordinator; Privacy Officer; and Records Management Officer. This position is responsible to manage achievement of compliance with legal mandates which apply to these areas.
This is a supervisory position and is eligible for a hybrid telework schedule, as there are some on-site responsibilities required.
About the Agency:The 1981 Legislature created OAH to offer Washingtonians an independent, fair, and neutral forum to hold administrative hearings on disputed matters referred by state and local government agencies. Operating out of field offices in Olympia, Tacoma, Seattle, and Spokane Valley there are currently 235 employees, including 120 Administrative Law Judges (ALJs) who preside over administrative hearings involving unemployment insurance benefits, child support, food assistance, medical benefits, business and professional licensing, and more.
OAH conducts hearings for more than 30 agencies and 160 programs. Our referring agencies include the Employment Security Department (ESD), Department of Social and Health Services (DSHS), Department of Children, Youth, and Families (DCYF), Health Care Authority (HCA), Liquor and Cannabis Board (LCB), Department of Financial Institutions (DFI), the Office of the Superintendent of Public Instruction (OSPI), and others.

Duties
The Information Governance Officer is the policy owner responsible to oversee the development, revision and implementation of the agency policies on public records, public information, privacy, records management, and litigation and discovery, and the training to support the policies' objectives. This position leads the agency's efforts to promote transparency and public disclosure compliance, as well as the agency's efforts to ensure that confidential information is protected as required by law.
This position is responsible for resolving complicated policy and procedure issues and strategizing the most effective course of action to fully comply with the mandates of the Public Records Act, Health Insurance Portability and Accountability Act (HIPAA) and other confidentiality laws, and minimize the agency's exposure to liability. This position influences strategy for records and information management and leads education efforts to create standards of process and procedures with data handling, storage, retention, and destruction. This position is responsible for directing the type of program activities which require close coordination with all OAH staff, referring agencies with data sharing agreements, and the Office of Attorney General (ATG).

Qualifications
Required qualifications:
  • Bachelor's Degree from accredited college/university with major study in business administration, public administration, or related field, OR four (4) years of related professional-level experience.
  • At least two (2) years of demonstrated, advanced experience and expertise in analyzing, interpreting, and applying rules, laws, and case law related to public records.
  • Demonstrated expert knowledge of and experience with the state and/or federal public records laws.
  • Demonstrated leadership and management experience, particularly in project and/or program management.

  • HIPAA Experience: Understanding of HIPAA requirements and data protection principles with regard to system requirements and data confidentiality.
  • Information Technology Understanding: Understanding of information technology (IT) and communication systems and their capabilities with regards to privacy.
  • Legal Discovery: Knowledge of state laws and rules relating to records retention and civil litigation discovery.
  • Legal Knowledge: Demonstrated knowledge of legal proceedings, including discovery and documentation production requirements.
  • Legal Writing Ability: Ability to draft documents, correspondence, rules, and policies.
  • Privacy Principles: Expertise in privacy requirements, principles, and processes.
  • Records Management: Knowledge of state laws and rules relating to records management.

Insurance Benefits

Retirement and Deferred Compensation
State Employees are members of the Washington Public Employees' Retirement System (PERS). New employees have the option of two employer contributed retirement programs. For additional information, check out the Department of Retirement Systems' web site.
Employees also have the ability to participate in the Deferred Compensation Program (DCP). This is a supplemental retirement savings program (similar to an IRA) that allows you control over the amount of pre-tax salary dollars you defer as well as the flexibility to choose between multiple investment options.
Social Security
All state employees are covered by the federal Social Security and Medicare systems. The state and the employee pay an equal amount into the system.
Public Service Loan Forgiveness
If you are employed by a government or not-for-profit organization, and meet the qualifying criteria, you may be eligible to receive student loan forgiveness under the Public Service Loan Forgiveness Program.
Holidays
Full-time and part-time employees are entitled to paid holidays and one paid personal holiday per calendar year.
Note: Employees who are members of certain Unions may be entitled to additional personal leave day(s), please refer to position specific Collective Bargaining Agreements for more information.
Full-time employees who work full monthly schedules qualify for holiday compensation if they are employed before the holiday and are in pay status for at least 80 nonovertime hours during the month of the holiday; or for the entire work shift preceding the holiday.
Part-time employees who are in pay status during the month of the holiday qualify for the holiday on a pro-rata basis. Compensation for holidays (including personal holiday) will be proportionate to the number of hours in pay status in the month to that required for full-time employment, excluding all holiday hours. Pay status includes hours worked and time on paid leave.
Sick Leave
Full-time employees earn eight hours of sick leave per month. Overtime eligible employees who are in pay status for less than 80 hours per month, earn a monthly proportionate to the number of hours in pay status, in the month to that required for full-time employment. Overtime exempt employees who are in pay status for less than 80 hours per month do not earn a monthly accrual of sick leave.
