Job Description
SUMMARY:

The Office of Institutional Compliance is a newly formed unit dedicated to support Montclair State University's compliance with local, state and federal laws, and University policies.
Reporting to the University Counsel, the Director of Institutional Compliance andTitle IX Coordinator ("the Director") is responsible for developing strategies and programs to promote and ensure compliance with federal regulations and state laws and University policies, including but not limited to Titles VI and VII of the Civil Rights Act and Title IX of the Education Amendments and New Jersey Law Against Discrimination. The Director shall serve as the University EEO/AA Officer and the University's Title IX Coordinator.
The Director develops and communicates information for the University community to promote employee knowledge of these laws, understanding of their rights and, where applicable, responsibilities under the law. The Director has primary responsibility for the intake and investigation of equity, discrimination and harassment complaints involving all community members.
The Director works with relevant University units to establish and review EEO/AA, Clery, VAWA, Title VII, and Title IX policies, codes and/or legal requirements that govern students, faculty, staff and visitors to the campus community.
PRINCIPAL DUTIES AND RESPONSIBILITIES:
  • Oversees all aspects of Institutional Equity, Compliance, and serves as the University's Equal Employment Opportunity/Affirmative Action (EEO/AA) officer and Title IX Coordinator; monitors compliance with EEO/AA policies and programs, and works with campus constituencies to facilitate the application of these policies and programs to daily actions, behaviors and decisions to support diversity, inclusiveness, equal access, and equitable treatment.
  • Develops, recommends and implements revisions and updates to University policies and procedures, as needed.
  • Reviews, assigns, investigates, mediates and resolves Title VII, Title IX and state discrimination, harassment and hostile work environment complaints and/or other acts of inappropriate conduct filed against employees of the University; prepares investigative reports in a timely manner, and makes recommendations on dispositions in accordance with established policies and procedures.
  • Collaborates and partners with Student Development and Campus Life and Athletics on University Policies (such as policies on NCAA), and Clery, VAWA, and other statutes impacting student development.
  • Supervises Compliance Assistant and external investigators on matters within their purview and reviews and approves investigation reports, determination, closure letters, and formal communications.
  • Communicates regularly and works strategically with the Deputy Title IX Coordinator(s) for Students on both the Montclair and Bloomfield campuses, and the Deputy Title IX Coordinator for Employees at Bloomfield
  • Partners with the Office of Inclusive Excellence on search committees EEO/AA guidelines and procedures and to promote the University's commitment to a diverse and inclusive workforce. This includes assisting units, convening groups, and search committees in promoting recruitment and selection processes that address implicit bias, and fostering diverse and representative candidate slates and finalist candidates from diverse racial, gender, and ethnic and cultural backgrounds.
  • Conducts new hire orientations, workshops, seminars or meetings addressing EEO/AA principles and goals, and is responsible to review, update and change training programs, as needed.
  • Ensures federal and state reporting requirements, and conducts related statistical analysis to evaluate University discrimination, harassment and hostile work environment complaints.
  • Represents the University internally and externally on EEO/AA and Title IX matters.
  • Performs other duties as assigned.

QUALIFICATIONS:
REQUIRED:
  • Bachelor's degree from accredited college or university.
  • A minimum of five years of directly applicable experience with increasing responsibility for leading the equity and Title IX function within a complex organization, preferably within a higher education environment.
  • Strong interpersonal skills including conflict resolution/mediation, superior writing, communication, analytical skills.
  • Ability to plan, coordinate and manage multiple projects simultaneously.
  • Highly organized and detail-oriented.
  • Experience with and sensitivity to individuals with diverse issues from diverse backgrounds.

PREFERRED:
  • Master's Degree or Juris Doctorate degree A demonstrable and proven track record of leadership, development and successful implementation of major diversity initiatives, particularly within the areas of employee or student recruitment
  • Direct knowledge, training and experience applying Title VII, Title IX, and other applicable federal and state laws and regulations related to EEO/AA
  • Strong proficiency in the use of the Microsoft Office suite products and development/generation of reports
  • Experience working in a unionized environment.
  • Experience working with students
