Job description

The Deputy Title IX Coordinator for Investigations (DTIXCI) reports directly to the Executive Director/Title IX Coordinator (TIXC). The DTIXCI assists the TIXC with the direction of the Office of Equity & Compliance/Title IX (OEC), and the University’s enforcement of the Sexual Misconduct Policy and Nondiscrimination and Equal Opportunity Policy.Primary responsibilities include shared oversight of the investigative processes for OEC matters. The DTIXCI will review and update policies and procedures related to the process of conducting investigations for situations that would, if true, violate the Sexual Misconduct or Nondiscrimination and Equal Opportunity policy, and advise the OEC’s investigators on matters related to conducting investigations, writing investigation reports, and remaining compliant with federal regulations and university policies. The DTIXCI will also serve as an investigator, when needed, and may be utilized as a decision-maker or facilitator of informal resolutions. Candidates must clearly understand policies and procedures relating to Title IX, Clery, VAWA, and their state counterparts.This position is identified as a Campus Security Authority (CSA) for Clery Act purposes and a Title IX Responsible Employee under Title IX. This designation requires annual training as well as other training requirements that the employee must complete. Any and all training requirements will be communicated to the employee. A CSA and Title IX Responsible Employee has ongoing reporting requirements in order to ensure compliance with the Jeanne Clery Act and Title IX regulations. Satisfactory completion and maintenance of associated training is required. Failure to meet these training requirements will result in disciplinary action, up to and including termination

ESSENTIAL FUNCTIONS AND RESPONSIBILITIES
  • Assist the TIXC by ensuring Liberty University’s compliance with all Virginia and federal laws related to anti-harassment and nondiscrimination for all protected classes.This includes, but is not limited to, Title IX of the Education Amendments of 1972 (“Title IX”); Titles VI and VII of the Civil Rights Act of 1964 (“Title VI” and “Title VII”); the Family Educational Rights and Privacy Act of 1974 (“FERPA”); Section 504 of the Rehabilitation Act of 1973 (“Section 504”); Title I of the Americans with Disabilities Act (the “ADA”); the Age Discrimination in Employment Act of 1967, as amended by the Older Worker’s Benefit Protection Act (the “ADEA”); the Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act (the “Clery Act”), as amended by the Violence Against Women Reauthorization Act of 2013 (“VAWA”); and Va.Code §§ 23.1-805 and 900.
  • Remain knowledgeable of Virginia and federal laws related to anti-harassment and nondiscrimination for all protected classes, and regulatory trends in higher education.
  • Shared oversight of OEC Investigators, and the investigation processes of OEC matters to ensure compliance with the Policy. Conduct regular and consistent meetings with individual investigators to ensure there is progress in each case and that accurate documentation is kept.
  • Collaborate with the Deputy Title IX Coordinator for Intake and Support and the Title IX Case Manager to assure proper procedures are followed after intakes with Complainants and Respondents, including when the TIXC or the complainant signs the formal complaint, and to ensure the Case Manager assigns each case to the DTIXCI’s preferred investigator.
  • Assist the Case Manager in determining which investigators are available for new duty assignments, including investigations, intakes for Nondiscrimination and Equal Opportunity policy violation reports, and adjudications.
  • Assist the TIXC in updating, revising, and evaluating the policies and procedures, internal office forms, office publications (manuals, website information, brochures, etc.), and other related materials.
  • Investigate cases and resolve preliminary inquiries, facilitate interim measures, and draft reports, ensuring a prompt, equitable, and neutral process for all parties that follow federal, state, and institutional policies and procedures when needed.
  • Assist with Clery Compliance by helping with Clery responsibilities around campus.
  • Responsible for understanding definitions of Prohibited Conduct under the Policy, grievance processes and complaint filing procedures, reporting requirements for employees and students, procedures for investigation and adjudication of complaints, interim measures, appeal rights (for all parties), and prohibitions on retaliation.
  • Act as liaison to faculty, staff, and administration regarding student- or employee-related problems related to Prohibited Conduct under the policies.
  • Maintain qualifications through ongoing training and professional development.
  • Work effectively as a team member, embracing and fostering the University’s mission.
SUPERVISORY RESPONSIBILITIES

This position is responsible for the shared supervision of OEC Investigators.

QUALIFICATIONS AND CREDENTIALSEducation and Experience

Minimum Required:

  • In-depth understanding of campus investigations, federal law related to discrimination, state law related to discrimination, evidence review and relevancy determination, investigative report writing
  • A Bachelor’s degree in a relevant field.
  • Completed all relevant Title IX training related to the profession including but not limited to: Title IX Investigator Training, Report Writing Training, and any other relevant training.
  • Ability to articulate and defend the unique Christian educational mission and vision of Liberty University and its subsidiaries to a wide variety of individuals and groups.

Preferred Qualifications:

  • A minimum of 5 years of experience in Title IX areas in higher education, showing a progression of responsibility and leadership.
  • A minimum of 5 years of supervisory experience in a dynamic office setting.
  • Subject Matter Expertise – Knowledge of and experience with issues to Title IX experience in a higher education setting strongly preferred.
  • Master’s degree in human resources, student affairs, higher education, public policy, government, criminal justice, legal studies, or other related discipline or JD preferred.
  • Prefer extensive working knowledge of software solutions for non-profits, CRM-Relationship management software, Ellucian Banner, Maxient, or similar incident tracking or law enforcement and compliance-related data and recordkeeping systems.
  • Experience with Clery Act Compliance.

WORKING CONDITIONSWork Environment

The working environment in which one will typically perform the essential functions of this position is a climate-controlled office setting. It is well lighted and the noise level is moderate.

Driving Requirements

Use of one’s personal vehicle (or LU vehicles) is required for travel to perform the essential functions of this position. Proof of a valid Virginia driver’s license, an acceptable DMV record, and liability insurance is required.
