Nature of Position
This position is regularly scheduled to work a 5 day, 37.5 hour work week, and is required to attend court on a regular basis.
Targeted start date in May 2024.
The City of Alameda is seeking one or more diligent, committed, and solutions-focused attorney to fill either the role of Deputy City Attorney I to serve as a prosecutor/trial Attorney In the Prosecution and Public Rights Unit of the City Attorney's Office. The Prosecution and Public Rights Unit represents the People of the State of California in prosecuting misdemeanor criminal matters, such as child/elder abuse, domestic violence, assault/battery, DUI, theft, and weapons charges. The Unit is further charged with bringing affirmative litigation in response to violations of consumer protection and fair housing laws. City prosecutors are dedicated to promoting and improving public safety and the quality of life in Alameda, through the fair, compassionate and effective administration of justice. Prior experience as a prosecutor is highly desirable but not required.

  • Salary: 2.5% base salary increase effective July 2024.
  • CalPERS Retirement: Classic Members: 2% at 55 formula, 8.868% contribution;New Members 2% @ 62 formula, 8.25% contribution.

Distinguishing Features
This is the entry level classification in the City Attorney series. Incumbents assist in the performance of City legal counsel duties and responsibilities.
Examples of Duties
  1. Represent the City and/or the People of the State of California in prosecuting violations of state and/or local laws through criminal, civil and/or administrative proceedings.
  2. Work closely with police agencies toward investigation and trial preparation of criminal and/or civil prosecutions.
  3. Meet with witnesses and victims to prepare cases for filing and/or trial.
  4. Draft and argue pleadings, motions and oppositions.
  5. Manage a large docket of ongoing criminal case assignments.
  6. May conduct public meetings, workshops and training session to provide community education.
  7. Other related work as required.

Employment Standards
Possession of the employment standards does not guarantee advancement to the examination or placement on the eligible list. This is a competitive examination where a candidate's performance in the examination will be evaluated in comparison with the core competencies required of the job.
Any combination equivalent to education and experience likely to provide the required knowledge and abilities. A typical way to obtain the knowledge and abilities would be:
Education: Equivalent to a Juris Doctor degree from an accredited law school.
Experience: None, however, practical legal experience is highly desirable. Such experience may include paid or unpaid externships, internships, fellowships or other part-time legal work.
Knowledge:
Knowledge of legal principles and practices including civil, criminal and administrative laws and procedures; judicial procedures and rules of evidence; methods of legal research; law and practices related to municipal government; principles and practices of public administration.
Ability
Ability to effectively represent the City in a variety of legal matters; perform routine professional legal work; provide legal advice and counsel; analyze, appraise, and apply legal principles and precedents to difficult legal problems; conduct legal research, prepare sound legal opinions and a variety of legal documents; set priorities, meet deadlines and make sound decisions; establish and maintain accurate records; maintain level of knowledge required for satisfactory job performance; communicate effectively; establish and maintain effective working relationships with employees, public officials, other departments and agencies and the general public.
Other Requirements
Ability to obtain membership with the State Bar of California within 12 months of employment.Possession of a valid California Driver's License and satisfactory driving record at the time of appointment is required as a condition of initial and continued employment only if the operation of a vehicle, rather than the employee's ability to get to/from various work locations in a timely manner, is necessary to perform the essential functions of the position.
SELECTION PROCESS:The examination process may include an application and supplemental questionnaire evaluation, a written exam, a performance exam, and/or an oral interview. The examination process may test for, but is not limited to, the essential knowledge and abilities listed in the job specification and announcement and will be designed to provide a comprehensive review of each candidate's technical knowledge and overall suitability for the position. Qualified applicants will be notified of the exact date, time, and location of examinations. Targeted start date in May 2024.Candidates passing all components of the examination process will be placed on an Eligible List. A list of names is certified to the department(s) having vacancies based on the type of examination conducted pursuant to the provision of the City's Civil Service Rules. Final selection will be made from the Eligible List by the City Attorney. The City Attorney may utilize additional selection procedures to make a final hiring decision. Placement on an Eligible List does not guarantee employment. Prior to appointment, a thorough reference check will be conducted which will include a credit and background check. The selection process may be evaluated and revised based on the number of qualified applicants. Federal law requires that prior to employment, you must furnish proof of your identity and eligibility for employment in the United States, as required the U.S. Citizenship and Immigration Services.
VETERAN'S PREFERENCE CREDIT: A job applicant qualifies as a veteran if honorably discharged from active military, reservist, or National Guard duty of at least 18 consecutive months within the past five (5) years of the date of application. In case of discharge attributable to service-connected injuries or illnesses, the 18 months active duty requirement need not be fulfilled.
