Nature of Work:
  • Under administrative direction, assists the Corporation Counsel/City Attorney in providing legal representation for the City of Evanston. The candidate will be responsible for handling complex litigation cases, with tasks to include preparing complaints, answers, discovery, motions, briefs and other legal documents. The Deputy City Attorney will conduct and participate in depositions and hearings. This position will be first chair for trials, arbitration and mediations. Acts as City Attorney, in the City Attorney's absence.
  • Duties include representing the City in various settings, including court hearings, trials, mediations and oral arguments in both state and federal court; rendering advice to City departments, officials and employees with regard to litigation and settlement of lawsuits; and offering advisory legal opinions particularly with regard to litigation or potential litigation. Ability to attend night meetings is required.
  • Additional duties may include drafting legal opinions and ordinances; advising various City staff, elected officials, municipal boards, committees or commissions; providing legal support and opinions with respect to zoning and land use matters; advising on general municipal issues including procurement, the City's Code of Ethics, the Illinois Local Records Act, the Illinois Open Meetings Act and the Illinois Freedom of Information Act.

Essential Functions (Specific assignment will include some or all of the following):
  • Represents the City and its employees as lead counsel concerning all aspects of cases in federal and state court. Includes taking cases to trial, analyzing and evaluating claims, drafting motions and pleadings; taking depositions; and issuing and answering discovery.
  • Drafts and/or reviews City ordinances, resolutions, contracts, purchases as directed. Researches, drafts, and provides legal opinions concerning all matters relating to municipal operations.
  • Provides oral and/or written legal advice as requested or directed by the City Attorney.
  • Acts as City's legal representative at administrative hearings before the City Boards, Committees and Commissions, and other State and City administrative boards when directed.
  • May determine appropriate legal action when ordinances are violated; prosecutes Housing and Building Code violations at Circuit Court or administrative hearings.
  • Attends night meetings as needed, which may include City Council meetings and meetings of the standing committees of the City Council, police review committee, and neighborhood meetings, as needed.
  • Advises client departments on legal compliance as necessary.

Minimum Requirements of Work:
  • Must possess a Juris Doctor from an accredited law school and be currently licensed to practice law in the State of Illinois.
  • Must possess seven (7) or more years of trial and litigation experience, preferably in a government setting. Possession of federal appellate and trial experience is preferred. Possession of litigation experience in municipal law and/or labor and employment law is preferred.
  • Must be admitted or eligible to be admitted to practice before the U.S. District Court for the Northern District of Illinois and the Federal Trial Bar.
  • Must possess a valid driver's license and a safe driving record.

Preferred Qualificiations:
Knowledge, skills, and abilities in the following areas:
  • Thorough knowledge of state and federal laws and established precedents with emphasis on tort immunity, equal protection, due process, personal injury defense, contract formation, civil procedure, and civil rights.
  • Substantive trial, litigation, and administrative hearing experience in state and federal court.
  • Knowledge of Federal Rules and Illinois Rules of Civil Procedure
  • Knowledge and understanding of Roberts Rules of Order
  • Knowledge of Illinois municipal law and practice, labor and employment law.
  • Knowledge of Open Meetings Act and Freedom of Information Act.
  • Knowledge of Illinois budget and appropriation statutes.
  • Knowledge of contracting, real estate, taxation, and zoning.
  • Ability to establish and maintain effective working relationships with a diverse group of “clients” and staff throughout the City and outside of the organization.
  • Ability to effectively represent the City in litigation when necessary.
  • Ability to multi-task and prioritize; ability to meet deadlines.
  • Ability to follow oral and written instructions.
  • Ability to manage and supervise professional and clerical staff.
  • Excellent organization, decision making, and time management skills.
  • Excellent communication and presentation skills; ability to write clearly and concisely.
  • Ability to attend evening City Council meetings.
