Overview:
This Recruitment Is Open to Current A Government Entity Staff Only!
Under Limited Direction, Plans and Directs the Activities and Operations of The City Attorney's Prosecution Office; Coordinates Assigned Activities with The Court and Outside Agencies;
Essential Functions:
  • Manage the Operations of The City Attorney's Prosecution Office, Including Oversight of All Criminal Functions, Supervision of Legal and Support Personnel and Annual Department Budget;
  • Advise the Mayor and City Council on Criminal Justice Policy Matters. May Represent the City on External Work Group, Committees, and Public Engagements Regarding the Criminal Justice System.
  • Participate in Establishing Departmental Guidelines, Goals, Priorities, and Efficient Office Operations; Provide Supervision, Guidance, Training, and Performance Evaluations of Deputy City Attorneys and Legal Interns.
  • Research and Write Legal Memoranda, Motions, and Briefs on Civil Matters Relating to Various Legislation, Municipal Ordinances; Provide Legal Advice and Prepare Legal Pleadings, and Other Court Documents
  • Coordinate Court Coverage; Develop and Review Prosecution Processes, Sentencing Recommendation Guidelines; Recommend and Implement Changes.
  • Collaborate with The Police Department, Municipal Court, and Other Agencies to Develop and Facilitate Programs for Prosecuting and Resolving Misdemeanor Criminal Cases, Including Implementing Changes in State and Local Laws, Training Officers, Recommending New Technology to Improve Prosecution Techniques, and Providing Legal Guidance; Participate in The Broad Efforts Addressing the Criminal Justice System.
  • Prosecute Misdemeanor Criminal Violations; Prepare for Pretrial Court Proceedings; Provide Discovery Pursuant to Montana State Law for Criminal Misdemeanors; Develop Appropriate Plea Agreements and Represent the City During Bench Trials in Municipal Court.
  • Interview Witnesses and Victims; Prepare Witnesses for Trial; Follow Rules of Evidence.
  • Monitor Suspended Sentences, and Petition Court to Revoke Suspended Sentences, when Warranted; Attend District Court Civil Implied Consent Refusal Hearings; Assist Civil Attorneys as Required.
  • Serve on The City's Management Team and Others, as Assigned.

Knowledge, Skills and Abilities:
  • Knowledge of Public Administration Principles and Practices, Including Budget Management, Employee Supervision and Training, and Risk Management.
  • Knowledge of And Ability to Interpret and Apply Federal, State, and Local Laws, Regulations, and Guidelines Relating to Municipal Operations, Including Montana Code Annotated, Missoula Municipal Code, Administrative Rules of Montana, and Uniform Technical Codes Adopted by The City.
  • Knowledge of Criminal and Civil Legal Practices and Procedures, Including Rules of Evidence, Conducting Legal Research, Preparing Court Documents, Pleadings, Motions, and Municipal Ordinances.
  • Skill in Preparing Cases for Trial, Litigating Cases, and Negotiating Plea Agreements.
  • Skill in Operating Office Equipment, Using Various Computer Software and Databases, Including Microsoft 365, and The Ability to Learn Job-Specific Applications and Equipment.
  • Skill in Negotiating and Communicating, in Person and Writing, with The Proven Ability to Establish and Maintain Effective Working Relationship with Diverse Individuals.
  • Ability to Problem-Solve and Resolve Conflicts with Facilitating Outcomes While Maintaining a Calm Demeanor.
  • Ability to Learn City and Departmental Policies, Procedures, and Practices.

Qualifications and Additional Application Materials
A Juris Doctorate from An Accredited Law School, and Seven (7) Years of Increasingly Responsible Experience as A Practicing Prosecuting Attorney, Including Prior Supervisory Responsibilities. Membership in The Montana State Bar and License to Practice Law in State Court Is Required. Must Pass a Fingerprint Criminal History Background Check. Municipal or Other Government Law, Preferred.
