POSITION SUMMARY


Conducts background investigations relative to the licensing and suitability of gaming employees and the Class II and Class III gaming vendors associated with the Tribe’s gaming facilities as a means of protection and maintaining the integrity of gaming. The Background Investigator will perform their duties under the direct supervision of the Director of Backgrounds and Licensing.   The investigations may require limited, local travel to El Dorado and adjoining counties to conduct public records research or other investigative contacts. Related duties include providing assistance to other gaming commission operations such as the Compliance Unit and the Internal Audit Unit that may require investigative or other technical assistance from time to time.  


ESSENTIAL FUNCTIONS

 

  1. Conduct thorough intake interviews with potential gaming employees, vendors, and management personnel and conduct detailed assessment and reviews of the applications being submitted by all individuals and businesses seeking to obtain gaming or vendor licenses from the Shingle Springs Gaming Commission.
  2. Obtain complete and legible fingerprints from all gaming license applications by use of either manually inked and rolled impressions or by use of a Live Scan fingerprinting system; transmits those fingerprints either manually or electronically to federal and/or state agencies and maintains accurate and current records of all fingerprint submissions and systematically documents the investigative process.
  3. Conduct reviews and assessments of qualifications for applicant licensing based upon criminal history records and other criteria.
  4. Maintain accurate records and security of all sensitive and/or confidential information obtained from business entities, credit bureau, database providers, government, or Tribal gaming agencies relative to individual applicants.
  5. Conduct comprehensive background investigations by use of professional investigative techniques and documents each aspect of the investigation; preparing written requests for the release of information and forwarding such requests to references, current and/or former employers, businesses, schools/colleges/universities, Tribal, State and Federal agencies and accurately documents the submittals and responses to each inquiry.
  6. Prepare detailed investigative reports or summaries of investigative findings; prepares recommendations for gaming license denials and/or favorable determinations of suitability for the Commission Chairman.
  7. Perform on-line data base searches on gaming license applicants’ credit reports or profiles, civil and criminal histories, residence histories and other related investigative research and maintains such records and the return information related to each search.
  8. Assist in the assessment of existing investigative protocols and provides input and recommendations for the development or guidelines designed to refine and strengthen the background investigations and licensing process for all gaming license applicants.
  9. Develop cooperative working relationships with other Tribal gaming commissions’ investigative units, the local courts and various government agencies or departments where public records are maintained, law enforcement agencies and state and federal regulatory agencies.
  10. Provide support and services to other Shingle Springs Gaming Commission units and the management of the gaming operation.
  11. Utilize and accurately maintain the various tracking systems and programs the gaming commission has in place for keeping track of gaming licensing renewals, billings, gaming license suspensions, conditions, or revocations and/or denials.
  12. Operate the Shingle Springs Gaming Commission Identification badge system, take ID photos of licensees, identify level of access based upon job positions then enable and program the ID badges and record each badge by number and name in the control system; accurately record and maintain the ID badge records for subsequent transmittal to State Gaming Agencies or other regulatory agencies for use by Unit Manager.
  13. Provide data entry in other existing commission databases for records storage.
  14. Understand and use computers and various software programs, telephones, cellular phones, fax machines, electronic mail, as well as have a working understanding of basic accounting principles, use of spreadsheets and basic business records.


MINIMUM QUALIFICATIONS

 

  1. High School Diploma or equivalent required.
  2. Experience in a similar position may be considered in lieu of education if the applicant’s additional qualifying knowledge and skills closely relate to the position’s skill set.
  3. Must be of excellent moral character and integrity and be willing to complete a contractual Conflict of Interest, Confidentiality and Non-Gaming Agreements.
  4. Must qualify for a gaming license and pass a background investigation that is as stringent as a gaming management employee.
  5. Maintain a current, valid, and unrestricted driver’s license.
  6. Must have three (3) or more years of verifiable full-time experience in performing Indian gaming background investigations or performing investigations in another field such as criminal, criminal defense, gaming compliance, civil litigations or in regulatory matters.
  7. Must have excellent verbal and written communication skills.
  8. Must understand basic legal concepts, civil and criminal court processes and have a general understanding of state and federal gaming statutes.


DRUG SCREEN


Shingle Springs Band of Miwok Indians requires the successful completion of a drug screening of all potential Tribal employees prior to being hired.  The Tribe recognizes that the State of California has legalized the use of marijuana. The Tribe is located on federally owned trust land and complies with federal laws. Therefore, marijuana use is prohibited, and all drug tests will include a screening for THC.

 

Shingle Springs Band of Miwok Indians recognizes a zero-tolerance drug and alcohol policy, and employees will be required to sign a Consent to Drug and/or Alcohol Testing.  Employees may be selected for alcohol / drug testing upon reasonable suspicion, and upon any/all accidents.

 

BACKGROUND CHECK


Candidates for this position will be subject to criminal and character background checks and fingerprinting prior to being hired.  Verification of previous employment and education will also be conducted after the interview if an offer of employment is being considered.

NATIVE PREFERENCE


Preference in hiring is given to the most qualified applicant.  However, when candidates for an open position are determined to be equally qualified, Native American candidates will have preference for hiring purposes. This means that if the qualifications of the best candidates are comparable, the Native American candidate is given preference.  The following order of preference shall be adhered to when hiring: (1) Members of Shingle Springs Band of Miwok Indians members; (2) Spouses or domestic partners (certified through Tribal Court or the State of California) of members of Shingle Springs Band of Miwok Indians; 3) Parents of children of the Shingle Springs Band of Miwok Indians; 4) All other documented Native Americans; 5) All other applicants in accordance with Title 25, U.S. Code, Section 472 and 473. Applicants claiming Indian preference must submit verification of Indian eligibility.
